AN ACT
T o amend chapter 34, RSMo, by adding thereto two new sections relating to government
contracts.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 34, RSMo, is amended by adding thereto two new sections, to be
2 known as sections 34.930 and 34.935, to read as follows:
34.930. 1. Any government entity that engages in bidding proc esses under the
2 pr ovisions of this chapter shall include the rubric used to evaluate bids in the initial
3 r equest for pr oposals.
4 2. Rubrics used in evaluating bids shall include, at a minimum:
5 (1) Criteria for evaluating the bids;
6 (2) W eight assigned to each criterion;
7 (3) Descriptors for what constitutes each level of performance; and
8 (4) Scoring ranges for each level of performance.
9 3. The division of pur chasing within the office of administration shall ensur e
10 compliance with the pr ovisions of this section.
34.935. 1. For all open bids that if no contract is awarded would r esult in a loss
2 of public services, government entities shall publish the requ est for pr oposals in a
3 newspaper of general circu lation in the area wher e the project req uesting bids is located.
4 2. Publications under subsection 1 of this section shall include:
5 (1) A description of the req uest for pr oposals and the anticipated loss of public
6 services if the contract is not awarded;

7 (2) Instructions on how to submit a bid in re sponse to the req uest for prop osals;
8 and
9 (3) Contact information for the entity that published the r equest for pr oposals.
10 3. Government entities shall also notify potential bidders of the req uest for
11 pr oposals thr ough the following means:
12 (1) Informational meetings;
13 (2) Direct communication to interes ted parties; and
14 (3) Publication in rel evant trade or industry publications.
15 4. The division of pur chasing within the office of administration shall ensur e
16 compliance with the pr ovisions of this section.
17 5. The division shall submit a rep ort to the legislature before August 28, 2027,
18 pr oviding specific examples of compliance with the prov isions of this section.
