AN ACT
T o repeal section 1 15.646, RSMo, and to enact in lieu thereof one new section relating to the
expenditure of public funds, with penalty provisions.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Section 1 15.646, RSMo, is repealed and one new section enacted in lieu
2 thereof, to be known as section 1 15.646, to read as follows:
1 15.646. No contribution or expenditure of public funds shall be made directly by any
2 of ficer , employee , or agent of any political subdivision, [ including school districts and charter
3 schools ] special district , or charter school to advocate, support, or oppose the passage or
4 defeat of any ballot measure or the nomination or election of any candidate for public of fice,
5 or to direct any public funds to, or pay any debts or obligations of, any committee supporting
6 or opposing such ballot measures or candidates. This section shall not be construed to
7 prohibit any public of ficial of a political subdivision, including school districts and charter
8 schools, from making public appearances or from issuing press releases concerning any such
9 ballot measure. Any purposeful violation of this section shall be punished as a class four
10 election of fense.
