AN ACT
T o amend chapter 167, RSMo, by adding thereto one new section relating to sunscreen.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 167, RSMo, is amended by adding thereto one new section, to be
2 known as section 167.628, to read as follows:
167.628. 1. As used in this section, "sunscr een" means a compound topically
2 applied to preven t sunburn.
3 2. A public school, which includes a charter school, shall permit a student,
4 without a par ent or physician's authorization, to possess and self-apply sunscr een that is
5 r egulated by the U.S. Food and Drug Administration.
6 3. If a student is unable to self-apply sunscr een, a school employee may apply the
7 sunscr een on the student if the student's par ent or guardian pr ovides written consent
8 for such assistance.
9 4. A school employee who applies sunscr een on a student in compliance with
10 subsection 3 of this section, as well as the employee's employer , shall not be liable for:
11 (1) An adverse reac tion suffer ed by the student as a r esult of having the
12 sunscr een applied; or
13 (2) Discontinuing the application of the sunscr een at any time.
