AN ACT
T o repeal sections 575.095 and 575.260, RSMo, and to enact in lieu thereof two new sections
relating to offenses involving tampering with a court-related of ficer or judicial
proceeding, with penalty provisions.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Sections 575.095 and 575.260, RSMo, are repealed and two new sections
2 enacted in lieu thereof, to be known as sections 575.095 and 575.260, to read as follows:
575.095. 1. A person commits the of fense of tampering with a [ judicial ] court-
2 r elated of ficer if, with the purpose to harass, intimidate , or influence a [ judicial ] court-
3 r elated of ficer in the performance of such officer' s of ficial duties, such person:
4 (1) Threatens or causes harm to such [ judicial ] court-r elated of ficer or members of
5 such [ judicial ] of ficer's family;
6 (2) Uses force, threats, or deception against or toward such [ judicial ] court-r elated
7 of ficer or members of such [ judicial ] of ficer's family;
8 (3) Of fers, conveys , or agrees to convey any benefit direct or indirect upon such
9 [ judicial ] court-r elated of ficer or such [ judicial ] of ficer's family;
10 (4) Engages in conduct reasonably calculated to harass or alarm such [ judicial ] court-
11 r elated of ficer or such [ judicial ] of ficer's family , including stalking pursuant to section
12 565.225 or 565.227;
13 (5) Disseminates through any means, including by posting on the internet, the
14 [ judicial of ficer's or the judicial of ficer's family's ] personal information of the court-r elated
15 officer or the officer's family . For purposes of this section, "personal information" [ includes
16 a home address, home or mobile telephone number , personal email address, Social Security
17 number , federal tax identification number , checking or savings account number , marital

18 status, and identity of a child under eighteen years of age ] shall have the same meaning as
19 defined in subdivision (5) of subsection 2 of section 476.1300 .
20 2. [ A judicial of ficer ] For purposes of this section , the term "court-rela ted officer"
21 shall [ be a judge or commissioner of a state or federal court, arbitrator , special master ,
22 juvenile of ficer , deputy juvenile of ficer , state prosecuting or circuit attorney , state assistant
23 prosecuting or circuit attorney , juvenile court commissioner , state probation or parole of ficer ,
24 or referee ] mean a judge or commissioner of a Missouri court, including any division of a
25 cir cuit court; a judge or commissioner of a federal court; an arbitrator , special master ,
26 or ref eree; a juvenile officer or deputy juvenile officer; a state prosecuting or cir cuit
27 attorney or assistant pr osecuting or cir cuit attorney; a court rep orter; a circu it clerk,
28 deputy cir cuit clerk, court administrator , division clerk, or municipal clerk; or a state
29 pr obation or par ole officer .
30 3. A [ judicial ] court-r elated officer' s family for purposes of this section shall be:
31 (1) Such of ficer's spouse; or
32 (2) Such of ficer or such of ficer's spouse's ancestor or descendant by blood or
33 adoption; or
34 (3) Such of ficer's stepchild, while the marriage creating that relationship exists.
35 4. The of fense of tampering with a [ judicial ] court-r elated of ficer is a class D felony .
36 5. If a violation of this section results in death or bodily injury to a [ judicial ] court-
37 r elated officer or a member of the [ judicial ] of ficer's family , the of fense is a class B felony .
38 6. No person convicted under subdivision (1) or (2) of subsection 1 or under
39 subsection 5 of this section shall be eligible for par ole.
575.260. 1. A person commits the of fense of tampering with a judicial proceeding if,
2 with the purpose to influence the of ficial action of a judge, juror , special master , referee,
3 arbitrator , state prosecuting or circuit attorney , state assistant prosecuting or circuit attorney ,
4 or attorney general in a judicial proceeding, [ he or she ] such person :
5 (1) Threatens or causes harm to any person or property; or
6 (2) Engages in conduct reasonably calculated to harass or alarm such of ficial or juror;
7 or
8 (3) Of fers, confers, or agrees to confer any benefit, direct or indirect, upon such
9 of ficial or juror .
10 2. The of fense of tampering with a judicial proceeding is a class D felony .
11 3. No person convicted under subdivision (1) of subsection 1 of this section shall
12 be eligible for par ole.
