AN ACT
T o amend chapter 620, RSMo, by adding thereto nine new sections relating to the Missouri
small business property crime prevention grant program.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 620, RSMo, is amended by adding thereto nine new sections, to
2 be known as sections 620.5010, 620.5012, 620.5014, 620.5016, 620.5018, 620.5020,
3 620.5022, 620.5024, and 620.5026, to read as follows:
620.5010. As used in sections 620.5010 to 620.5026, the following terms mean:
2 (1) "Department", the department of economic development;
3 (2) "Grant", a grant to a small business under the pr ogram;
4 (3) "Progra m", the Missouri small business pro perty crime preven tion grant
5 pr ogram established in section 620.5012;
6 (4) "Small business", a for -pr ofit, independently owned enterprise consisting of
7 fewer than fifty full-time or part-time employees.
620.5012. 1. Subject to appr opriation, the department of economic development
2 shall establish the "Missouri Small Business Pr operty Crime Pr evention Grant
3 Pr ogram" to pr ovide grants to small businesses in this state to improve their safety
4 and security thr ough physical security upgrades and to assist small businesses with costs
5 associated with r epairing damage caused during the commission of prop erty crimes.
6 2. The department shall award grants for each fiscal year beginning with grants
7 for fiscal year 2028 and ending with grants for the fiscal year immediately prece ding the
8 fiscal year in which the pr ogram sunsets under section 620.5026. All grants shall be
9 awarded fr om the fund established under section 620.5022.

10 3. The total amount of grants that may be awarded to a single small business
11 under the pr ogram in any one fiscal year shall not exceed one thousand dollars.
620.5014. 1. Any small business seeking a grant under the pr ogram shall submit
2 an application to the department at least sixty days before July first of the fiscal year for
3 which the grant is sought.
4 2. A small business shall be eligible for a grant if the small business:
5 (1) Is located within this state;
6 (2) Submits a detailed grant application that outlines the specific needs of the
7 small business and how the funds will be used to addr ess those needs; and
8 (3) Pr ovides a cost break down of the prop osed improvements or r epairs,
9 including any security systems and structural r enovations.
620.5016. Any small business awarded a grant shall use the grant moneys solely
2 for:
3 (1) Enhanced security measur es, including the installation of surveillance
4 systems, access contr ol systems, lighting, and alarm systems;
5 (2) The re modeling or redesign ing of small business storef ronts to impr ove
6 security and pr event unauthorized access; or
7 (3) Assistance with costs associated with r epairing damage caused during the
8 commission of a pr operty crime.
620.5018. 1. The department shall establish a revi ew committee to evaluate all
2 grant applications based on the following criteria:
3 (1) The severity of the security needs of the small business;
4 (2) The extent of the damage for which r epairs ar e needed;
5 (3) The feasibility of the pr oposed use of grant funds; and
6 (4) The demonstrated ability of the small business to complete the pro posed
7 security improv ements within a reas onable time frame.
8 2. The department shall award grants based on the review committee's
9 evaluation and shall notify small businesses of their award status within thirty days
10 after the date on which the grant applications were due.
620.5020. 1. Any small business that receiv es a grant under the progra m shall
2 submit an annual r eport to the department detailing:
3 (1) The progr ess made in implementing the funded rep airs or security measur es;
4 and
5 (2) Any challenges encountered in executing the r epairs or security
6 impr ovements.
7 2. Any small business that r eceives a grant for repa irs or security upgrades shall
8 complete the repa irs or security upgrades within eighteen months of recei pt of the grant.

9 The department may rev oke the rem aining funds allocated under a grant to a small
10 business that fails to meet this deadline.
620.5022. 1. Ther e is her eby cr eated in the state tr easury the "Missouri Small
2 Business Pro perty Crime Pr evention Pr ogram Fund", which shall consist of moneys
3 appr opriated to it by the general assembly and any gifts, contributions, grants, or
4 bequests recei ved fr om federal, private, or other sour ces. The state tr easur er shall be
5 custodian of the fund. In accordance with sections 30.170 and 30.180, the state tre asurer
6 may appr ove disbursements. The fund shall be a dedicated fund and, upon
7 appr opriation, moneys in this fund shall be used solely to award grants under the
8 pr ogram.
9 2. The pro visions of section 33.080 rel ating to the transfer of unexpended
10 balances to the general reven ue fund shall not apply to the fund until June thirtieth of
11 the fiscal year immediately preced ing the fiscal year in which the pr ogram sunsets, at
12 which time the unexpended balance in the fund shall be transferred to general reven ue
13 and the fund shall be abolished.
14 3. The state tr easure r shall invest moneys in the fund in the same manner as
15 other funds ar e invested. Any interes t and moneys earned on such investments shall be
16 cr edited to the fund.
620.5024. The department may pr omulgate rules to implement the provi sions of
2 sections 620.5010 to 620.5026. Any rule or portion of a rule, as that term is defined in
3 section 536.010, that is crea ted under the authority delegated in this section shall
4 become effective only if it complies with and is subject to all of the provi sions of chapter
5 536 and, if applicable, section 536.028. This section and chapter 536 are nonseverable
6 and if any of the powers vested with the general assembly pursuant to chapter 536 to
7 r eview , to delay the effective date, or to disappr ove and annul a rule are subsequently
8 held unconstitutional, then the grant of rulemaking authority and any rule pr oposed or
9 adopted after August 28, 2026, shall be invalid and void.
620.5026. Under section 23.253 of the Missouri sunset act:
2 (1) The pr ovisions of the new pr ogram authorized under sections 620.5000 to
3 620.5024 shall automatically sunset six years after the effective date of sections 620.5000
4 to 620.5024 unless reau thorized by an act of the general assembly; and
5 (2) Sections 620.5010 to 620.5026 shall terminate on September first of the
6 calendar year immediately following the calendar year in which the prog ram authorized
7 under sections 620.5010 to 620.5026 is sunset.
