AN ACT
T o amend chapter 281, RSMo, by adding thereto one new section relating to certain
herbicides, with penalty provisions.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 281, RSMo, is amended by adding thereto one new section, to be
2 known as section 281.130, to read as follows:
281.130. 1. This section shall be known as and may be cited as the "Paraquat
2 Ban and Envir onmental Research Act of 2026".
3 2. As used in this section, the following terms mean:
4 (1) "Department", the department of agricultur e;
5 (2) "Paraquat", any herbicide pr oduct containing paraquat dichloride or any
6 other chemical form of paraquat;
7 (3) "Person", any individual, firm, entity , partnership, exchange, association,
8 trustee, re ceiver , corporation or any other business organization, and any member ,
9 officer , or employee ther eof;
10 (4) "Use", the application, distribution, sale, or handling of paraquat within this
11 state.
12 3. (1) Beginning January 1, 2027, except as provi ded under subdivision (2) of
13 this subsection, the use of paraquat is proh ibited in this state.
14 (2) The department of agricultur e, in consultation with the department of
15 natural res ourc es, may , by rule, allow the limited use of paraquat for res ear ch purposes
16 only when such res earc h is conducted under strict safety and repor ting protocols
17 established by the department of agricultur e.
EXPLANA TION — Matter enclosed in bold-faced brackets [thus] in the above bill is not enacted and is
intended to be omitted from the law . Matter in bold-face type in the above bill is proposed language.
18 4. (1) Befor e January 1, 2027, all persons that curr ently use, distribute, or sell
19 paraquat in this state shall submit a detailed rep ort or repo rts to the department
20 including, but not limited to, the:
21 (a) Quantity of paraquat used, sold, or distributed in the pr eceding year;
22 (b) Geographic area s where paraquat is used;
23 (c) T ypes of cr ops or applications for which paraquat is used; and
24 (d) Any other information that the department shall requ ire by rule or
25 r egulation.
26 (2) The department shall compile and publish these reports , including the
27 publication of a statewide paraquat use repo rt, including usage by county and by type of
28 cr op, on the department's internet website that is accessible to the public and the
29 legislatur e. The department shall publish such repo rts within a reas onable time but no
30 later than March 31, 2027, and every year ther eafter .
31 5. Any person who violates the prov isions of subsection 3 of this section shall be
32 subject to a fine or penalty in the amount of two hundr ed fifty dollars for the first
33 violation and no mor e than five hundr ed dollars for each subsequent violation. The
34 department shall determine the method and proced ure for collecting the fines for any
35 violation or violations committed by a person including, but not limited to, any
36 enfor cement action that is warranted against the person. The department may
37 coordinate with the attorney general's office as needed to enforce the pro visions of
38 subsection 3 of this section.
39 6. The department shall promul gate all necessary rules and r egulations for the
40 administration of this section including, but not limited to, fines and penalties. Any rule
41 or portion of a rule, as that term is defined in section 536.010, that is cr eated under the
42 authority delegated in this section shall become effective only if it complies with and is
43 subject to all of the pr ovisions of chapter 536 and, if applicable, section 536.028. This
44 section and chapter 536 are nonseverable and if any of the powers vested with the
45 general assembly pursuant to chapter 536 to revie w , to delay the effective date, or to
46 disappr ove and annul a rule ar e subsequently held unconstitutional, then the grant of
47 rulemaking authority and any rule pr oposed or adopted after August 28, 2026, shall be
48 invalid and void.
