AN ACT
T o amend chapter 288, RSMo, by adding thereto two new sections relating to unemployment
administration adjustments.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 288, RSMo, is amended by adding thereto two new sections, to be
2 known as sections 288.135 and 288.136, to read as follows:
288.135. 1. This is her eby creat ed in the state tr easury the "Unemployment
2 Administration Adjustment Fund", which shall consist of money collected pursuant to
3 section 288.136, and such other state funds appr opriated by the general assembly . The
4 state tr easurer shall be custodian of the fund and may appr ove disbursements fr om the
5 fund in accordance with sections 30.170 and 30.180. Upon appr opriation, money in the
6 fund shall be used solely for the purpose of defraying the cost of the administration of
7 this law , and for no other purpose whatsoever . Notwithstanding the pro visions of
8 section 33.080 to the contrary , all moneys rem aining in the fund at the end of the
9 biennium shall not r evert to the cr edit of the general r evenue fund. The state tre asurer
10 shall invest moneys in the fund in the same manner as other funds ar e invested. Any
11 inter est and money earned on such investments shall be credited to the fund.
12 2. The unemployment administration adjustment fund shall not be used in whole
13 or in part for any purpose or in any manner that would permit its substitution for , or a
14 corr esponding reduction in, federal funds that would be available in its absence to
15 finance expenditures for the administration of this chapter , or cause the appr opriate
16 agency of the United States government to withhold any part of an administrative grant
17 that would otherwise be made.

288.136. 1. Each employer liable for contributions pursuant to this chapter ,
2 except employers with a contribution rate equal to zer o, shall pay an annual
3 unemployment administration adjustment in an amount equal to five one-hundred ths
4 of one per cent of such employer's total taxable wages for the twelve-month period
5 ending the precedi ng June thirtieth.
6 2. Notwithstanding subsection 1 of this section to the contrary , when the
7 September thirtieth balance of the unemployment administration adjustment fund is
8 forty million dollars or mor e, or if the average balance of the unemployment
9 compensation trust fund of the four prece ding quarters (September thirtieth, June
10 thirtieth, March thirty-first, December thirty-first) is less than four hundred fifty
11 million dollars, no unemployment administration adjustment shall be applied in the
12 succeeding calendar year .
13 3. Each employer liable to pay an unemployment administration adjustment
14 shall be notified of the amount due under this section by March thirty-first of each year
15 and such amount shall be consider ed delinquent thirty days ther eafter . Delinquent
16 unemployment administration adjustment amounts may be collected in the manner
17 pr ovided under sections 288.160 and 288.170. All moneys collected under this section
18 shall be deposited in the unemployment administration adjustment fund established in
19 section 288.135.
20 4. For the first quarter of each calendar year , the total amount of contribution
21 otherwise due fro m each employer liable to pay contributions under this chapter shall
22 be red uced by the dollar amount due fr om such employer pursuant to the calculation in
23 subsection 1 of this section. However , the amount of contributions due fr om such
24 employer for the first quarter of the calendar year in question shall not be redu ced
25 below zero.
