AN ACT
T o amend chapter 167, RSMo, by adding thereto one new section relating to ultraprocessed
food in schools.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 167, RSMo, is amended by adding thereto one new section, to be
2 known as section 167.207, to read as follows:
167.207. 1. This section shall be known and may be cited as the "Missouri
2 Healthy Schools Act".
3 2. For the purposes of this section, "ultraproces sed food" means a food or
4 beverage that contains one or mor e of the following ingr edients:
5 (1) Potassium br omate;
6 (2) Pr opylparaben;
7 (3) T itanium dioxide;
8 (4) Br ominated vegetable oil;
9 (5) Y ellow dye 5;
10 (6) Y ellow dye 6;
11 (7) Blue dye 1;
12 (8) Blue dye 2;
13 (9) Green dye 3;
14 (10) Red dye 3;
15 (1 1) Red dye 40.
16 3. Beginning in the 2027-2028 school year and for all subsequent school years,
17 any school that participates in a federally funded or assisted meal pr ogram shall not

18 serve, sell, or allow a third party to sell ultrapr ocessed food on the school campus during
19 the school day . This subsection shall not be construed to pr ohibit a student's par ent or
20 guardian from provi ding ultrapr ocessed food to the student during the school day .
21 4. The department of elementary and secondary education shall post on the
22 department's website both of the following:
23 (1) A standardized form that a public school may use to certify that the public
24 school is complying with the r equir ements of this section; and
25 (2) A list of each public school that has certified to the department that the
26 public school is complying with the req uirements of this section.
