AN ACT
T o amend chapter 376, RSMo, by adding thereto one new section relating to insurance
coverage of prescription drugs for advanced, metastatic cancer .
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 376, RSMo, is amended by adding thereto one new section, to be
2 known as section 376.2040, to read as follows:
376.2040. 1. As used in this section, the following terms mean:
2 (1) "Advanced, metastatic cancer", cancer that has spr ead fro m the primary or
3 original site of the cancer to nearby tissues, lymph nodes, or other areas or parts of the
4 body;
5 (2) "Associated condition", any symptom or side effect that is associated with
6 advanced, metastatic cancer or its tr eatment and that, in the judgment of the health car e
7 practitioner , further jeopardizes the health of a patient if left untreat ed;
8 (3) "Enro llee", the same meaning given to the term in section 376.1350;
9 (4) "Health benefit plan", the same meaning given to the term in section
10 376.1350. The term "health benefit plan" shall also include MO HealthNet.
11 2. A health benefit plan that prov ides coverage for advanced, metastatic cancer
12 and associated conditions shall not req uire, before the health benefit plan pr ovides
13 coverage of a prescrip tion drug for advanced, metastatic cancer or an associated
14 condition, that the enr ollee:
15 (1) Fail to successfully res pond to a differ ent drug; or
16 (2) Pr ove a history of failure of a differ ent drug.
17 3. This section applies only to a drug the use of which is:

18 (1) Consistent with best practices for the trea tment of advanced, metastatic
19 cancer or an associated condition;
20 (2) Supported by peer -r eviewed, evidence-based literature; and
21 (3) Appr oved by the United States Food and Drug Administration.
