AN ACT
T o repeal section 1 10.240, RSMo, and to enact in lieu thereof one new section relating to
county treasurers.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Section 1 10.240, RSMo, is repealed and one new section enacted in lieu
2 thereof, to be known as section 1 10.240, to read as follows:
1 10.240. 1. It is the duty of the county treasurer to draw a check as county treasurer
2 upon a county depositary in favor of the legal holder thereof, and to char ge the same to the
3 fund upon which it is drawn. No county treasurer shall draw any check upon the funds in any
4 depositary unless there is suff icient money belonging to the fund upon which the check is
5 drawn to pay the same, and no money belonging to the county shall be paid by any depositary
6 except upon checks of the county treasurer . In case any bonds, coupons or other indebtedness
7 of the county are payable by the terms of the bonds, coupons or other debts at any particular
8 place other than the treasury of the county , nothing contained in this section shall prevent any
9 county commission from causing the treasurer to place a suf ficient sum at the place where
10 such debts shall be payable, at the time of their maturity , to meet the same.
11 2. As pr ovided in this section and in sections 50.166 and 54.140, the county
12 tr easur er ’ s signature shall be the only signatur e authorized or permitted on any bank
13 signatur e card, deposit agr eement, or other authorization document for any account
14 maintained in a county depositary for county funds under the tr easur er ’ s custody . No
15 other county official or employee shall be authorized or r equir ed to be listed as a signer
16 on any such account. Each county depositary shall ensur e compliance with this
17 subsection.

18 3. Nothing in this section shall be construed to pr ohibit any other county officer
19 fr om maintaining a separate account or accounts specifically authorized by statute for
20 the performance of that officer ’ s official duties.
21 4. Nothing in this section shall be construed to limit or otherwise affect the
22 authority of the county commission under section 50.160 to r equest or obtain
23 information, accounts, record s, or other financial documentation fr om the county
24 tr easur er .
