AN ACT
T o amend chapter 407, RSMo, by adding thereto one new section relating to retail
establishments, with a penalty provision.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 407, RSMo, is amended by adding thereto one new section, to be
2 known as section 407.215, to read as follows:
407.215. 1. Except as pr ovided under subsection 2 of this section, all ret ail
2 establishments, including, but not limited to, sports venues, concert venues, halls, fairs,
3 and Missouri State High School Activities Association (MSHSAA) events offering goods
4 or services for sale shall accept United States curr ency , including Federal Reserve notes,
5 fr om a buyer to purch ase the goods or services.
6 2. This section does not apply to:
7 (1) Any ret ail transaction conducted at fuel-dispensing equipment thr ough an
8 automated, unattended, or self-service system, without on-site personnel to accept or
9 secur e cash payments;
10 (2) Any online r etail transaction of any kind;
11 (3) Any reta il transaction that requ ires :
12 (a) A security deposit be placed on a cred it card; or
13 (b) A credi t card number be provi ded to cover unfor eseen damages or expenses;
14 (4) Any r etail establishment that uses a device to convert a consumer's cash into
15 a pre paid card that allows the consumer to complete a transaction at the reta il
16 establishment if:
17 (a) The transaction does not include a fee;
EXPLANA TION — Matter enclosed in bold-faced brackets [thus] in the above bill is not enacted and is
intended to be omitted from the law . Matter in bold-face type in the above bill is proposed language.
18 (b) The transaction does not req uire a minimum deposit amount great er than
19 one dollar;
20 (c) Upon req uest, the consumer is pr ovided with a receip t indicating the amount
21 of cash the consumer deposited onto the pr epaid card; and
22 (d) The underlying moneys on the prepa id card are not subject to an expiration
23 date, and ther e is no limit on the number of transactions that may be completed using
24 the prep aid card; or
25 (5) Any ret ail establishment with mor e than one point of sale at a single addr ess
26 if one or mor e points of sale at the addr ess accept United States curre ncy , including
27 Federal Reserve notes.
28 3. Failing to accept United States curr ency fr om a buyer as r equir ed by this
29 section is a class D misdemeanor and, upon conviction, shall be punished by a fine of not
30 mor e than five hundr ed dollars per transaction or attempted transaction.
