AN ACT
T o amend chapter 643, RSMo, by adding thereto one new section relating to air conservation.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 643, RSMo, is amended by adding thereto one new section, to be
2 known as section 643.680, to read as follows:
643.680. 1. The intentional injection, r elease, or dispersion, by any means, of
2 chemicals, chemical compounds, substances, or apparatus within the borders of this
3 state into the atmospher e with the express purpose of affecting temperatur e, weather , or
4 the intensity of the sunlight is pro hibited.
5 2. The air conservation commission of the state of Missouri established under
6 section 643.040 shall establish standards and guidelines for the enforcem ent of this
7 section.
8 3. The department of natural res ources may pr omulgate all necessary rules and
9 r egulations for the administration of this section. Any rule or portion of a rule, as that
10 term is defined in section 536.010, that is creat ed under the authority delegated in this
11 section shall become effective only if it complies with and is subject to all of the
12 pr ovisions of chapter 536 and, if applicable, section 536.028. This section and chapter
13 536 are nonseverable and if any of the powers vested with the general assembly
14 pursuant to chapter 536 to revi ew , to delay the effective date, or to disappr ove and annul
15 a rule are subsequently held unconstitutional, then the grant of rulemaking authority
16 and any rule prop osed or adopted after August 28, 2026, shall be invalid and void.
