AN ACT
T o amend chapter 67, RSMo, by adding thereto one new section relating to licensing for
mobile food units.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 67, RSMo, is amended by adding thereto one new section, to be
2 known as section 67.31 1, to read as follows:
67.31 1 . 1. As used in this section, the following terms shall mean:
2 (1) "County", any county with mor e than seven hundr ed thousand but fewer
3 than eight hundred thousand inhabitants;
4 (2) "Mobile food unit", a vehicle-mounted food service establishment, designed
5 to be r eadily movable, that r eturns to a commissary daily for clean-up and service;
6 (3) "Municipality", any city , town, or village located wholly or partially within a
7 county .
8 2. Notwithstanding any pro vision of law to the contrary , any license or permit
9 issued by a county to a mobile food unit or operator shall be sufficient to allow such
10 mobile food unit or operator to operate in all municipalities within such county . Any
11 permitting req uirement imposed by a municipality that is mor e strict than the
12 permitting requ irem ents imposed by a county shall be null and void.
13 3. The pr ovisions of this section shall not be construed to pr ohibit or limit any
14 health or food sanitation regu lations authorized in chapter 196 or any other pro vision of
15 law .
