AN ACT
T o amend chapter 191, RSMo, by adding thereto one new section relating to nutrition
prescriptions.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 191, RSMo, is amended by adding thereto one new section, to be
2 known as section 191.849, to read as follows:
191.849. 1. As used in this section, the following terms mean:
2 (1) "Eligible foods", whole, unpr ocessed fruits and vegetables that are gr own or
3 pr oduced in this state;
4 (2) "Eligible prod ucer", a prod ucer who:
5 (a) Operates primarily in this state to pr oduce eligible foods; and
6 (b) Meets standards established by rule of the department of health and senior
7 services;
8 (3) "Licensed health car e pro vider", a physician, advanced practice register ed
9 nurse, physician assistant, or dietitian or nutritionist licensed to pr ovide services in this
10 state;
11 (4) "Nutrition pr escription", a written or electr onic recomme ndation issued by a
12 licensed health care prov ider for consumption of specific categories of food;
13 (5) "Participation":
14 (a) For licensed health car e pr oviders, issuing a nutrition pr escription;
15 (b) For patients, r eceiving and filling a nutrition pr escription; and
16 (c) For prod ucers or nonprof it prog rams, pr oviding foods for the fulfillment of
17 nutrition pr escriptions;
EXPLANA TION — Matter enclosed in bold-faced brackets [thus] in the above bill is not enacted and is
intended to be omitted from the law . Matter in bold-face type in the above bill is proposed language.
18 (6) "Prod ucer", a farmer or food pr oducer .
19 2. Licensed health car e provi ders may issue nutrition pr escriptions for diet-
20 sensitive conditions including, but not limited to, diabetes, hypertension, and
2 1 cardiovascular disease.
22 3. Any nonprof it pr ogram appr oved by the department of health and senior
23 services may fulfill a nutrition prescrip tion issued in accordance with this section. A
24 nonpr ofit prog ram shall be eligible for appr oval to fulfill nutrition prescrip tions only if
25 the pro gram is:
26 (1) A food-as-medicine pr ogram operated by a hospital or health system;
27 (2) A pr ogram operated by any of the following philanthr opic or nonpr ofit
28 organizations:
29 (a) A food bank;
30 (b) A foundation;
31 (c) A local health nonpr ofit; or
32 (d) A faith-based organization; or
33 (3) A dir ect partnership with an eligible prod ucer .
34 4. Participation by licensed health care pro viders, patients, prod ucers, and
35 nonpr ofit progr ams is voluntary .
36 5. Participation under this section shall not affect a patient's eligibility for
37 benefits under the Supplemental Nutrition Assistance Pr ogram or the Special
3 8 Supplemental Nutrition Pr ogram for W omen, Infants, and Children.
39 6. The department of health and senior services shall pr omulgate rules to
40 implement this section including, but not limited to, rules establishing eligibility
41 standards for foods pr ovided under nutrition pr escriptions and participation standards
42 for prod ucers and nonpr ofit pr ograms fulfilling nutrition pr escriptions. Any rule or
43 portion of a rule, as that term is defined in section 536.010, that is creat ed under the
44 authority delegated in this section shall become effective only if it complies with and is
45 subject to all of the pr ovisions of chapter 536 and, if applicable, section 536.028. This
46 section and chapter 536 are nonseverable and if any of the powers vested with the
47 general assembly pursuant to chapter 536 to revie w , to delay the effective date, or to
48 disappr ove and annul a rule ar e subsequently held unconstitutional, then the grant of
49 rulemaking authority and any rule pr oposed or adopted after August 28, 2026, shall be
50 invalid and void.
