AN ACT
T o amend chapter 590, RSMo, by adding thereto one new section relating to law enforcement
of ficer identification, with a penalty provision.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 590, RSMo, is amended by adding thereto one new section, to be
2 known as section 590.1095, to read as follows:
590.1095. 1. For purposes of this section, the following terms mean:
2 (1) "Facial covering", any opaque mask, garment, helmet, headgear , or other
3 item that conceals or obscur es the facial identity of an individual including, but not
4 limited to, a balaclava, tactical mask, gaiter , ski mask, and any similar type of facial
5 covering or face-shielding item. A facial covering does not include any of the following:
6 (a) A translucent face shield or clear mask that does not conceal or obscure the
7 wear er's facial identity;
8 (b) An N95 medical mask or surgical mask worn to pr otect against transmission
9 of disease or infection, or any other mask, helmet, or device including, but not limited to,
10 air -purifying r espirators, full or half masks, or self-contained br eathing apparatus
11 necessary to protect against exposur e to any toxin, gas, smoke, inclement weather , or
12 any other hazardous or harmful envir onmental condition;
13 (c) A mask, helmet, or device including, but not limited to, a self-contained
14 br eathing apparatus, necessary for underwater use;
15 (d) A motor cycle helmet when worn by an agent utilizing a motor cycle or other
16 vehicle that requ ires a helmet for safe operation while in the performance of their
17 duties; or
EXPLANA TION — Matter enclosed in bold-faced brackets [thus] in the above bill is not enacted and is
intended to be omitted from the law . Matter in bold-face type in the above bill is proposed language.
18 (e) Eyewear necessary to pr otect fr om the use of ret inal weapons including, but
19 not limited to, lasers;
20 (2) "Law enforcem ent officer", any peace officer licensed under this chapter and
21 any federal law enforcem ent agent including, but not limited to, agents performing
22 Immigration and Customs Enfor cement (ICE) operations in this state.
23 2. Any law enforcem ent officer performing official duties in the state shall visibly
24 display identification that includes the officer's name, rank, and badge number . Such
25 officers shall not wear facial coverings that conceal or obscur e their facial identity in the
26 performance of official duties, except as expr essly authorized in this section.
27 3. This section shall not apply to law enfor cement officers who ar e:
28 (1) Performing their duties as under cover operatives during an active
29 under cover operation or as needed to pr otect their identity following the conclusion
30 of an under cover operation;
31 (2) Assigned to a Special Response T eam (SR T) while actively performing their
32 SR T r esponsibilities;
33 (3) Assigned to a Special W eapons And T actic (SW A T) unit while actively
34 performing their SW A T res ponsibilities;
35 (4) Pr oviding emergency r esponse wher ein exigent cir cumstances prev ent the
36 officer from identifying himself or herself; and
37 (5) Performing duties wher ein the officer cannot r easonably identify himself or
38 herself due to public safety concerns.
39 4. A willful and knowing violation of this section is punishable as a class A
40 misdemeanor .
