AN ACT
T o amend chapters 208 and 376, RSMo, by adding thereto two new sections relating to
payments for vasectomies.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapters 208 and 376, RSMo, are amended by adding thereto two new
2 sections, to be known as sections 208.667 and 376.1 170, to read as follows:
208.667. 1. Subject to appr opriation, ther e is her eby established within the
2 department of social services a state assistance pr ogram to cover the cost of vasectomies
3 for uninsured res idents of this state.
4 2. Every male person who is a res ident of this state and who does not have
5 employer -sponsor ed health insurance coverage or coverage under a public health
6 insurance pro gram shall be eligible for full coverage of the cost of a vasectomy under the
7 pr ogram. Notwithstanding any pr ovision of this chapter to the contrary , a person's
8 income or res ource s shall not be consider ed to determine eligibility for the pr ogram.
9 The department of social services shall establish by rule an application process to verify
10 eligibility for the pro gram.
11 3. The department of social services shall not requ ire a finding of medical
12 necessity for the vasectomy or establish any other r estrictions on eligibility other than
13 those res trictions specified in this section.
14 4. The department of social services shall make payments for vasectomies to
15 appr opriate medical pr oviders on behalf of persons eligible under this section on the
16 basis of the r easonable cost of the vasectomies as defined and determined by the
17 department by rule.

18 5. The progr am creat ed under this section is subject to the annual appr opriation
19 of funds by the general assembly . Benefits are limited by moneys so appr opriated.
20 6. (1) Ther e is her eby crea ted in the state tr easury the "V asectomy Fund",
21 which shall consist of moneys appr opriated to it by the general assembly and any gift,
22 contributions, grants, or bequests fro m federal, private, or other sources . The state
23 tr easur er shall be custodian of the fund. In accordance with sections 30.170 and 30.180,
24 the state tr easurer may appr ove disbursements. The fund shall be a dedicated fund and,
25 upon appr opriation, moneys in this fund shall be used solely for payments for
26 vasectomies pro vided throu gh the pr ogram crea ted under this section and for
27 administrative expenses associated with the pro gram.
28 (2) Notwithstanding the pro visions of section 33.080 to the contrary , any moneys
29 r emaining in the fund at the end of the biennium shall not r evert to the credit of the
30 general reven ue fund.
31 (3) The state tre asurer shall invest moneys in the fund in the same manner as
32 other funds ar e invested. Any interes t and moneys earned on such investments shall be
33 cr edited to the fund.
34 7. The department of social services shall promul gate rules to implement the
35 pr ovisions of this section. Any rule or portion of a rule, as that term is defined in section
36 536.010, that is creat ed under the authority delegated in this section shall become
37 effective only if it complies with and is subject to all of the pro visions of chapter 536 and,
38 if applicable, section 536.028. This section and chapter 536 are nonseverable and if any
39 of the powers vested with the general assembly pursuant to chapter 536 to re view , to
40 delay the effective date, or to disappr ove and annul a rule are subsequently held
41 unconstitutional, then the grant of rulemaking authority and any rule prop osed or
42 adopted after August 28, 2026, shall be invalid and void.
376.1 170. 1. As used in this section, the terms "health carrier" and "health
2 benefit plan" shall have the same meanings given to the terms in section 376.1350.
3 2. Each health carrier or health benefit plan that offers or issues health benefit
4 plans that ar e deliver ed, issued for delivery , continued, or r enewed in this state on or
5 after January 1, 2027, shall pro vide coverage for vasectomies.
6 3. A health carrier or health benefit plan shall not req uire a finding of medical
7 necessity for the vasectomy or establish any other res trictions on eligibility for the
8 coverage requ ired under this section.
9 4. Health car e services r equir ed by this section shall not be subject to any great er
10 deductible or co-payment than any other health care service pro vided by the health
11 benefit plan.

12 5. The prov isions of this section shall not apply to a supplemental insurance
13 policy , including a life care contract, accident-only policy , specified disease policy ,
14 hospital policy pr oviding a fixed daily benefit only , Medicare supplement policy , long-
15 term car e policy , short-term major medical policy of six months' or less duration, or any
16 other supplemental policy as determined by the dir ector of the department of commer ce
17 and insurance.
