AN ACT
T o amend chapter 82, RSMo, by adding thereto one new section relating to data center
construction.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 82, RSMo, is amended by adding thereto one new section, to be
2 known as section 82.1070, to read as follows:
82.1070. 1. As used in this section, the following terms mean:
2 (1) "Application", any application, reque st, filing, or submission, whether
3 complete or incomplete, formal or informal;
4 (2) "Data center", a building, gro up of buildings, or facility whose purpose is
5 data pr ocessing, distribution, or data storage, and is used to house computer systems,
6 servers, and associated components including, but not limited to, central pr ocessing
7 units, graphical pr ocessing units, neural networks, quantum bits, quantum pro cessors,
8 memory , data ro uting, data storage, data war ehouses, server farms, bitcoin mining,
9 crypto pr ocessing, virtual private networks, virtual servers, artificial intelligence
10 training or pro cessing, image pr ocessing, cloud computing, email servicing, a telecom
11 hotel, telehouse colocation, or any other term applicable to facilities which are used for
12 such purposes.
13 2. The acceptance, pro cessing, or appr oval of any application that would allow
14 for the acquisition, construction, r econstruction, or alteration of facilities for the
15 cr eation or expansion of data centers shall be paused until August 28, 2027.
16 Applications submitted before August 28, 2026, shall not be affected by such pause
17 and shall proceed under established proced ures.

18 3. The pause provi ded for in subsection 2 shall apply only to departments,
19 divisions, boards, commissions, councils, and agencies in a city not within a county .
