AN ACT
T o repeal section 160.534, RSMo, and to enact in lieu thereof two new sections relating to
funding for historically black colleges and universities.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Section 160.534, RSMo, is repealed and two new sections enacted in lieu
2 thereof, to be known as sections 160.534 and 173.1030, to read as follows:
160.534. For fiscal year 1996 and each subsequent fiscal year , any amount of the
2 excursion gambling boat proceeds deposited in the gaming proceeds for education fund in
3 excess of the [ amount ] amounts transferred to the school district bond fund as provided in
4 section 164.303 and the stren gthening HBCUs fund as pr ovided in section 173.1030 shall
5 be transferred to the classroom trust fund. Such moneys shall be distributed in the manner
6 provided in section 163.043.
173.1030. 1. This section shall be known and may be cited as the "Str engthening
2 HBCUs Act".
3 2. As used in this section, the term "historically black colleges and universities"
4 or "HBCUs" means institutions eligible to receive grant awards under the federal
5 Str engthening Historically Black Colleges and Universities Pr ogram creat ed under 20
6 U.S.C. Section 1060 et seq., as determined under 34 CFR 608.2.
7 3. (1) Ther e is her eby cr eated in the state tr easury the "Str engthening HBCUs
8 Fund", which shall consist of moneys transferred to the fund as pro vided in subsection 4
9 of this section and any gifts, contributions, grants, or donations receiv ed fr om federal,
10 private, or other sources . The state tr easurer shall be custodian of the fund. In
11 accordance with sections 30.170 and 30.180, the state tre asure r may appr ove

12 disbursements. The fund shall be a dedicated fund and, upon appr opriation, moneys in
13 this fund shall be used solely as pro vided in subsection 5 of this section.
14 (2) Notwithstanding the pro visions of section 33.080 to the contrary , any moneys
15 r emaining in the fund at the end of the biennium shall not r evert to the credit of the
16 general reven ue fund.
17 (3) The state tre asurer shall invest moneys in the fund in the same manner as
18 other funds ar e invested. Any interes t and moneys earned on such investments shall be
19 cr edited to the fund.
20 4. (1) One percent of all excursion gambling boat pro ceeds shall be transferr ed
21 to the str engthening HBCUs fund fr om the gaming proc eeds for education fund creat ed
22 in section 313.822 before any amounts in the gaming proce eds for education fund are
23 transferr ed to the school district bond fund as pr ovided in section 164.303 or the
24 classr oom trust fund as pr ovided in section 160.534.
25 (2) One percen t of all net pr oceeds receive d fro m the Missouri state lottery after
26 payment of prizes and administrative expenses shall be transferr ed to the str engthening
27 HBCUs fund fro m the lottery pro ceeds fund creat ed in Article III, Section 39(b) of the
28 Constitution of Missouri before any amounts in the lottery pr oceeds fund are
29 transferr ed for any other purpose.
30 5. Moneys in the stren gthening HBCUs fund shall stand appr opriated without
31 further legislative action to all historically black colleges and universities in this state on
32 an equal basis to be used solely for:
33 (1) A capital pr oject for which financing is permitted under the federal HBCU
34 Capital Financing Pr ogram, as determined under 20 U.S.C. Section 1066a(5); or
35 (2) Any activity for which a grant award is permitted under the federal
36 Str engthening Historically Black Colleges and Universities Pr ogram, as determined
37 under 20 U.S.C. Section 1062.
38 6. Nothing in this section re quir es historically black colleges and universities to
39 have obtained federal funding under a pr ogram named in this section in order to rec eive
40 and expend the funds appr opriated to them.
41 7. Funding authorized under this section shall be used to supplement, not
42 supplant, the level of funding historically black colleges and universities r eceived under
43 appr opriations made for fiscal year 2027.
