AN ACT
T o repeal section 160.572, RSMo, and to enact in lieu thereof two new sections relating to
college and career readiness.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Section 160.572, RSMo, is repealed and two new sections enacted in lieu
2 thereof, to be known as sections 160.572 and 173.1360, to read as follows:
160.572. 1. For purposes of this section, the following terms shall mean:
2 (1) ["ACT assessment", the ACT assessment or the ACT Plus W riting assessment;
3 (2) ] "High school", a public school, not including a charter school, that pro vides
4 instruction to students in any combinations of grades nine, ten, eleven, or twelve;
5 (2) "W orkKeys", the ACT W orkKeys assessments required for the National Career
6 Readiness Certificate.
7 2. [ (1) In any school year in which the department of elementary and secondary
8 education directs a state-funded census administration of the ACT assessment to any group of
9 students, any student who would be allowed or required to participate in the census
10 administration shall receive the opportunity , on any date within three months before the
11 census administration, to participate in a state-funded administration of W orkKeys.
12 (2) Any student who participated in a state-funded administration of W orkKeys as
13 described under subdivision (1) of this subsection shall not participate in any state-funded
14 census administration of the ACT assessment.
15 (3) The department of elementary and secondary education shall not require school
16 districts or charter schools to administer the ACT assessment to any student who participated
17 in a state-funded administration of W orkKeys as described under subdivision (1) of this

18 subsection] Each high school shall administer college and career r eadiness assessments,
19 including a car eer readi ness assessment that leads to a nationally reco gnized work
20 r eadiness certificate, in a manner and fr equency prescrib ed by the state board of
21 education to each student before the student graduates fr om high school .
22 3. [ (1) In any school year in which a school district directs the administration of the
23 ACT assessment to any group of its students to be funded by the district, any student who
24 would be allowed or required to participate in the district-funded administration shall receive
25 the opportunity , on any date within three months before the administration, to participate in an
26 administration of W orkKeys funded by the school district.
27 (2) Nothing in this section shall require a school district to fund the administration of
28 the ACT assessment to any student who participated in a district-funded administration of
29 W orkKeys as described under subdivision (1) of this subsection] A car eer r eadiness
30 assessment under subsection 2 of this section may include W orkKeys .
31 4. A public school district may offer additional college and career r eadiness
32 assessments for students enr olled in high school, at no cost to the student, by using funds
33 appr opriated by the general assembly for such purpose.
34 5. The state board of education shall promul gate rules to implement the
35 pr ovisions of this section. Any rule or portion of a rule, as that term is defined in section
36 536.010, that is creat ed under the authority delegated in this section shall become
37 effective only if it complies with and is subject to all of the pro visions of chapter 536 and,
38 if applicable, section 536.028. This section and chapter 536 are nonseverable and if any
39 of the powers vested with the general assembly pursuant to chapter 536 to re view , to
40 delay the effective date, or to disappr ove and annul a rule are subsequently held
41 unconstitutional, then the grant of rulemaking authority and any rule prop osed or
42 adopted after August 28, 2026, shall be invalid and void.
173.1360 . Each public institution of higher education may adopt and implement
2 a policy to use a Platinum, Gold, or Silver cred ential earned thr ough the ACT
3 W orkKeys National Car eer Readiness Certificate (NCRC) as transcribable credit
4 toward the attainment of a postsecondary technical degr ee as r ecommended by the
5 American Council on Education (ACE) national guide.
