AN ACT
T o amend chapter 217, RSMo, by adding thereto one new section relating to the
establishment of the "Homes for Missouri Program" within the department of
corrections.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 217, RSMo, is amended by adding thereto one new section, to be
2 known as section 217.995, to read as follows:
217.995. 1. There is her eby established within the department of corr ections the
2 "Homes for Missouri Pr ogram". Notwithstanding the provi sions of any other law to the
3 contrary , the direc tor is authorized to contract with nonprof it entities for inmate work
4 involving the construction of single-family homes and other r esidential structur es in
5 ar eas within the state with documented affordable housing shortages with such single-
6 family homes and other structures to be sold at below-market, cost-based prices.
7 2. The department may contract with one or mor e nonpr ofit organizations to
8 administer , manage, market, or otherwise operate the pr ogram. Any contract
9 authorized under this section shall be in compliance with state and federal law .
10 3. Participation in the pr ogram shall be voluntary and contingent upon
11 eligibility criteria established by the department.
12 4. The pr ogram shall incorporate structur ed vocational training and workfor ce
13 development components including, but not limited to:
14 (1) On the job training in res idential construction trades including, but not
15 limited to, carpentry , electrical work, plumbing, masonry , framing, and roo fing;
16 (2) Classr oom instruction integrated with hands-on construction experience;

17 (3) Opportunities to earn industry-r ecognized crede ntials and certifications
18 including, but not limited to, Occupational Safety and Health Administration (OSHA)
19 safety certifications, National Center for Construction Education and Resear ch
20 (NCCER) cr edentials, appr enticeship hours recogn ized by the Missouri department of
21 labor and industrial rela tions, and other cr edentials appr oved by the department; and
22 (4) Documentation of hours worked and competencies achieved to assist
23 participants in securing post-r elease employment.
24 5. The dir ector of the department of corr ections may promulg ate all necessary
25 rules and reg ulations for the administration of this section. Any rule or portion of a
26 rule, as that term is defined in section 536.010, that is crea ted under the authority
27 delegated in this section shall become effective only if it complies with and is subject to
28 all of the pr ovisions of chapter 536 and, if applicable, section 536.028. This section and
29 chapter 536 are nonseverable and if any of the powers vested with the general assembly
30 pursuant to chapter 536 to revi ew , to delay the effective date, or to disappr ove and annul
31 a rule are subsequently held unconstitutional, then the grant of rulemaking authority
32 and any rule prop osed or adopted after August 28, 2026, shall be invalid and void.
33 6. Under section 23.253 of the Missouri sunset act:
34 (1) The prov isions of the new pr ogram authorized under this section shall sunset
35 six years after the effective date of this section unless reauthori zed by an act of the
36 general assembly; and
37 (2) This section shall terminate on September first of the calendar year
38 immediately following the calendar year in which the prog ram authorized under this
39 section is sunset.
