JOINT RESOLUTION
Submitting to the qualified voters of Missouri an amendment repealing Section 12 of Article
III of the Constitution of Missouri, and adopting one new section in lieu thereof
relating to employment of members of the general assembly .
Be it r esolved by the House of Repr esentatives, the Senate concurring ther ein:
That at the next general election to be held in the state of Missouri, on T uesday next
2 following the first Monday in November , 2026, or at a special election to be called by the
3 governor for that purpose, there is hereby submitted to the qualified voters of this state, for
4 adoption or rejection, the following amendment to Article III of the Constitution of the state
5 of Missouri:
Section A. Section 12, Article III, Constitution of Missouri, is repealed and one new
2 section adopted in lieu thereof, to be known as Section 12, to read as follows:
Section 12. 1. No person holding any lucrative of fice or employment under the
2 United States, this state or any municipality thereof shall hold the of fice of senator or
3 representative. When any senator or representative accepts any of fice or employment under
4 the United States, this state or any municipality thereof, [ his ] such senator's or
5 r epresent ative's of fice shall thereby be vacated and [ he ] such individual shall thereafter
6 perform no duty and receive no salary as senator or representative.
7 2. During the term for which [ he ] a senator or re present ative was elected , no
8 senator or representative shall accept any appointive of fice or employment under this state
9 which is created or the emoluments of which are increased during such term.

10 3. This section shall not apply to members of the or ganized militia, of the reserve
11 corps , and of school boards[ , ] ; employees of school districts; and notaries public.
