HOUSE RESOLUTION NO. 3879

WHEREAS, on August 29, 2025, Governor Michael Kehoe, acting on orders from
2 President Donald J. T rump, called an extraordinary session of the Missouri General Assembly
3 for the purpose of enacting an unprecedented mid-decade re-gerrymandering of Missouri's
4 congressional districts; and

6 WHEREAS, on September 12, 2025, majority Republicans in the legislature truly
7 agreed to and finally passed House Bill 1; and
8
9 WHEREAS, prior to House Bill 1, Missouri's congressional map was already
10 gerrymandered to create six safe Republican seats and just two safe Democratic seats, despite
11 approximately forty percent of voters supporting Democratic congressional candidates in
12 recent elections; and

14 WHEREAS, House Bill 1 further gerrymandered Missouri's congressional districts in
15 an attempt to create a congressional delegation consisting of seven Republicans and just one
16 Democrat; and

18 WHEREAS, Governor Kehoe signed House Bill 1 into law on September 29, 2025;
19 and
20
21 WHEREAS, Missourians throughout the state were outraged at the gross abuse of
22 power the governor and his legislative supporters engaged in to enact new congressional
23 districts to benefit the Republican Party at the detriment of Missouri voters; and
24
25 WHEREAS, pursuant to Article III, Section 52(a) of the Constitution of Missouri, the
26 people of Missouri mobilized under the group People Not Politicians to exercise their right to
27 force a statewide vote on House Bill 1 to prevent it from taking ef fect unless approved by a
28 majority of voters at the next general election; and

30 WHEREAS, on December 9, 2025, People Not Politicians submitted to the Secretary
31 of State's Office a referendum petition on House Bill 1 containing approximately 305,000
32 signatures from registered Missouri voters, a number that approaches triple the minimum
33 number of roughly 107,000 signatures needed to refer House Bill 1 to the November 3, 2026,
34 general election ballot; and

36 WHEREAS, Article III, Section 52(b) of the Constitution of Missouri says: "Any
37 measure referred to the people shall take ef fect when approved by a majority of the votes cast
38 thereon, and not otherwise," House Bill 1 immediately was suspended from taking ef fect until
39 voters decide the issue at the next general election; and

41 WHEREAS, Secretary of State Denny Hoskins stated in an interview with the
42 Missouri Independent that, arbitrarily and unlawfully , he will refuse to verify any signatures
43 gathered prior to October 14, 2025, even though the strict ninety-day constitutional window
44 for gathering signatures on the House Bill 1 referendum petition opened on September 12,
45 2025; and

47 WHEREAS, Secretary Hoskins further stated that, despite the submission of the
48 referendum petition and the plain language of the constitution suspending legislation subject
49 to a referendum, House Bill 1 took ef fect as a scheduled on December 1 1, 2025; and

51 WHEREAS, Secretary Hoskins said he is instructing local election of ficials to begin
52 implementing the newly re-gerrymandered congressional districts for the 2026 election cycle,
53 even though they are constitutionally suspended from taking effect; and

55 WHEREAS, Article VII, Section 1 of the Constitution of Missouri says, in relevant
56 part: "All elective executive of ficials of the state ... shall be liable to impeachment for crimes,
57 misconduct, habitual drunkenness, willful neglect of duty , corruption in of fice, incompetency ,
58 or any of fense involving moral turpitude or oppression in office,"; and

60 WHEREAS, Secretary Hoskins's actions of unlawfully obstructing the House Bill 1
61 referendum petition and instructing election of ficials to implement new congressional
62 districts in violation of the constitutional right of Missourians to vote on any act of the
63 General Assembly prior to it becoming law , constitute several violations of Article VII,
64 Section 1, of the Constitution of Missouri including, but not necessarily limited to,
65 misconduct, willful neglect of duty , incompetency , and oppression in of fice; and

67 WHEREAS, Secretary Hoskins's actions are an af front to the people of this state, the
68 Constitution of Missouri, and basic democratic principles:

70 NOW THEREFORE BE IT RESOL VED that the members of the Missouri House
71 of Representatives, One Hundred Third General Assembly , Second Regular Session, hereby
72 authorize a House committee selected by the Speaker pursuant to House Rule 63(3) to
73 introduce, upon finding of good cause, articles of impeachment against Secretary of State
74 Denny Hoskins.
