SB 1064 - Under this act, the state's laws shall preempt any local laws, ordinances, orders, rules, or regulations enacted by a county, municipality, or other political subdivision of the state regulating the sale of tobacco products, alternative nicotine products, or vapor products.

AN ACT
To repeal section 407.932, RSMo, and to enact in lieu thereof one new section relating to tobacco
products.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Section 407.932, RSMo, is repealed and one new 1
section enacted in lieu thereof, to be known as section 407.932, 2
to read as follows:3
407.932. [Nothing in sections 407.925 to 407.932 shall 1
prohibit local political subdivisions from enacting more 2
stringent ordinances or rules.] 1. The state preempts the 3
field of regulating the sale of tobacco products, 4
alternative nicotine products, and vapor products, 5
including, but not limited to, local ordinances dealing with 6
ingredients, setting the age to sell or purchase over twenty- 7
one years of age, licensing bans, and product bans. The 8
provisions of sections 407.924 to 407.934 shall supersede 9
any local laws, ordinances, orders, rules, or regulations 10
enacted by a county, municipality, or other political 11
subdivision to regulate the sale of tobacco products, 12
alternative nicotine products, or vapor products. 13
2. The provisions of this section shall not be 14
construed to prohibit counties, municipalities, or other 15
political subdivisions from enforcing ordinances or 16
regulations that set the age to sell or purchase tobacco 17

to persons under twenty-one years of age. 19
3. The provisions of this section shall not be 20
construed to preempt any local laws, ordinances, orders, 21
rules, or regulations relating to tobacco products, 22
alternative nicotine products, or vapor products that are 23
enacted by a county, municipality, or other political 24
subdivision and that are in effect as of January 1, 2026. 25
Any such local law, ordinance, order, rule, or regulation 26
that is enacted or amended after January 1, 2026, shall be 27
subject to the provisions of this section. 28
