AN ACT
To repeal section 43.265, RSMo, and to enact in lieu thereof one new section relating to vehicle
purchases by the state highway patrol.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Section 43.265, RSMo, is repealed and one new 1
section enacted in lieu thereof, to be known as section 43.265, 2
to read as follows:3
43.265. There is hereby created in the state treasury 1
the "Highway Patrol's Motor Vehicle, Aircraft, and 2
Watercraft Revolving Fund", which shall be administered by 3
the superintendent of the highway patrol. All funds 4
received by the highway patrol from: 5
(1) Any source for purchase and maintenance of highway 6
patrol motor vehicles, watercraft, watercraft motors, and 7
trailers; 8
(2) Any source for reimbursement of costs associated 9
with the official use of highway patrol vehicles; 10
(3) Any source for restitution for damage to or loss 11
of a highway patrol vehicle or aircraft; 12
(4) Any other source for the purchase and maintenance 13
of highway patrol aircraft or aircraft parts; and 14
(5) Government agencies for the reimbursement of costs 15
associated with aircraft flights flown on their behalf by 16
the highway patrol; 17

shall be credited to the fund. The state treasurer is the 18
custodian of the fund and shall approve disbursements from 19
the fund subject to appropriation and as provided by law and 20
the constitution of this state at the request of the 21
superintendent of the highway patrol. The balances from 22
this fund shall be used for the purchase and maintenance of 23
highway patrol motor vehicles, highway patrol watercraft, 24
watercraft motors, and trailers, highway patrol aircraft or 25
aircraft parts and operational costs. Prior to obligating 26
any funds for the purchase of an individual unit that costs 27
in excess of [one] five hundred thousand dollars, the 28
highway patrol shall receive a specific appropriation from 29
the general assembly for the particular purchase. Any 30
unexpended balance in the fund at the end of the fiscal year 31
shall be exempt from the provisions of section 33.080 32
relating to the transfer of unexpended balances to the 33
general revenue fund. 34
