SB 1099 - This act provides that all federal acts, laws, executive orders, administrative orders, rules, and regulations that restrict the people's right to keep and bear certain types of arms shall not be recognized or enforced by this state.

It shall be the duty of the courts and law enforcement agencies of this state to protect the rights of law-abiding citizens to keep and bear arms within the borders of this state and to protect these rights from the infringements by the federal government.

AN ACT
To amend chapter 1, RSMo, by adding thereto one new section relating to the protection of second
amendment rights.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Chapter 1, RSMo, is amended by adding thereto 1
one new section, to be known as section 1.487, to read as 2
follows:3
1.487. 1. The general assembly declares that: 1
(1) The freedom and protection that follow from the 2
right to keep and bear arms as granted by Amendment II of 3
the Constitution of the United States are meaningless in a 4
society where the federal government ostensibly maintains 5
the power to determine which arms the people may or may not 6
bear; 7
(2) Any federal act, law, executive order, rule, or 8
regulation that restricts the type of arms that law abiding 9
citizens may bear is a transparent attempt to maintain 10
control of the people in violation of the sacred trust the 11
people have put into the federal government to act as agents 12
on their behalf; and 13
(3) The state of Missouri will not violate the 14
sovereignty of its own people by assisting, aiding, or in 15
any other way furthering the restriction of the rights 16

granted to them by their creator, as put down by the 17
founding fathers of this country. 18
2. Notwithstanding any provision of law to the 19
contrary, all federal acts, laws, executive orders, 20
administrative orders, rules, and regulations, regardless of 21
whether they were enacted before or after the provisions of 22
this section, that restrict the people's right to keep and 23
bear the following types of arms, as guaranteed by the 24
Second Amendment to the Constitution of the United States 25
and Article I, Section 23 of the Constitution of Missouri, 26
shall be invalid to this state, shall not be recognized by 27
this state, shall be specifically rejected by this state, 28
and shall not be enforced by this state: 29
(1) Any weapon which shoots, is designed to shoot, or 30
can be readily restored to shoot, automatically more than 31
one shot, without manual reloading, by a single function of 32
the trigger; 33
(2) The frame or receiver of any weapon described in 34
subdivision (1) of this subsection, or any part designed and 35
intended solely and exclusively, or combination of parts 36
designed and intended, for use in converting a weapon into a 37
weapon described in subdivision (1) of this subsection; 38
(3) Any combination of parts from which a weapon can 39
be assembled as described in subdivision (1) of this 40
subsection if such parts are in the possession or under the 41
control of a person; and 42
(4) Any other weapon or part that meets the definition 43
of "machinegun" as provided in 26 U.S.C. 5845(b). 44
3. It shall be the duty of the courts and law 45
enforcement agencies of this state to protect the rights of 46
law-abiding citizens to keep and bear arms within the 47

borders of this state and to protect these rights from the 48
infringements by the federal government. 49
