AN ACT
To amend chapter 173, RSMo, by adding thereto one new section relating to accommodations for
students with disabilities at public institutions of higher education.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Chapter 173, RSMo, is amended by adding thereto 1
one new section, to be known as section 173.2000, to read as 2
follows:3
173.2000. 1. This section shall be known and may be 1
cited as the "Missouri Respond, Innovate, Succeed, and 2
Empower (RISE) Act". 3
2. Each public institution of higher education shall 4
adopt a policy that makes any of the following documentation 5
submitted by an enrolled or admitted student sufficient to 6
establish that the student is an individual with a 7
disability for purposes of determining such student's 8
eligibility for disability accommodations at such 9
institution: 10
(1) Documentation that the individual has had an 11
Individualized Education Program (IEP) in accordance with 12
the federal Individuals with Disabilities Education Act, 20 13
U.S.C. Section 1400, et seq., as amended, and that such IEP 14
represents an ongoing need for disability accommodations 15
that has not ended; 16

(2) Documentation that the individual has received 17
services or accommodations pursuant to Section 504 of the 18
Rehabilitation Act of 1973, 29 U.S.C. Section 794, as 19
amended, and that such services or accommodations represent 20
an ongoing need for disability accommodations that has not 21
ended; 22
(3) Documentation of a plan or record of service for 23
the individual from a private school, a local education 24
agency, a state educational agency, or an institution of 25
higher education provided in accordance with the Americans 26
with Disabilities Act of 1990, 42 U.S.C. Section 12101, et 27
seq., as amended; 28
(4) A record or evaluation from a relevant licensed 29
professional acting within the scope of practice for which 30
such professional is licensed finding that the individual 31
has a disability; 32
(5) A plan or record of a disability from another 33
institution of higher education; or 34
(6) Documentation of a disability due to military 35
service in the uniformed services. 36
3. A public institution of higher education may 37
establish less burdensome criteria than the criteria 38
prescribed in subsection 2 of this section to establish that 39
a student is an individual with a disability. 40
4. The policy adopted pursuant to this section shall 41
be transparent and explicit regarding information about the 42
process by which the public institution of higher education 43
shall determine the eligibility for accommodations for an 44
individual with a disability. Each public institution of 45
higher education shall disseminate such information to 46
students, parents, and faculty in accessible formats, 47
including during any student orientation, and shall make the 48

information readily available on a public website of the 49
institution. 50
5. The coordinating board for higher education may 51
promulgate rules to implement the provisions of this 52
section. Any rule or portion of a rule, as that term is 53
defined in section 536.010, that is created under the 54
authority delegated in this section shall become effective 55
only if it complies with and is subject to all of the 56
provisions of chapter 536 and, if applicable, section 57
536.028. This section and chapter 536 are nonseverable and 58
if any of the powers vested with the general assembly 59
pursuant to chapter 536 to review, to delay the effective 60
date, or to disapprove and annul a rule are subsequently 61
held unconstitutional, then the grant of rulemaking 62
authority and any rule proposed or adopted after August 28, 63
2026, shall be invalid and void. 64
