SB 1167 - This act creates the offense of possession of an abortifacient drug with the intent to induce an abortion on oneself or another person and the offense of delivery of an abortifacient drug with the intent to induce, or otherwise assist in, an abortion on another person. These offenses are Class C felonies. It shall be an affirmative defense for either offense that the possession or delivery of the drug was because of an abortion induced due to a medical emergency.

AN ACT
To amend chapter 579, RSMo, by adding thereto one new section relating to abortifacient drugs,
with penalty provisions.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Chapter 579, RSMo, is amended by adding thereto 1
one new section, to be known as section 579.017, to read as 2
follows:3
579.017. 1. (1) A person commits the offense of 1
possession of an abortifacient drug if he or she knowingly 2
possesses an abortifacient drug, including, but not limited 3
to, mifepristone (RU-486) or any other drug used alone or in 4
combination with another to induce an abortion, with the 5
intent to induce an abortion on themselves or another person. 6
(2) The offense of possession of an abortifacient drug 7
is a class C felony. 8
(3) It shall be an affirmative defense for any person 9
to allege to have violated this subsection that the person 10
knowingly possessed the abortifacient drug to induce an 11
abortion because of a medical emergency, as such term is 12
defined in section 188.015. 13
2. (1) A person commits the offense of delivery of an 14
abortifacient drug if he or she knowingly distributes or 15
delivers, attempts to distribute or deliver, or knowingly 16
possesses with an intent to distribute or deliver, an 17

abortifacient drug, including, but not limited to, 18
mifepristone (RU-486) or any other drug used alone or in 19
combination with another to induce an abortion, with the 20
intent to induce, or otherwise assist in inducing, an 21
abortion on another person. 22
(2) The offense of delivery of an abortifacient drug 23
is a class C felony. 24
(3) It shall be an affirmative defense for any person 25
to allege to have violated this subsection that the person 26
knowingly distributed or delivered the abortifacient drug to 27
induce an abortion because of a medical emergency, as such 28
term is defined in section 188.015. 29
