AN ACT
To repeal section 194.321, RSMo, relating to organ transplant procedures.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Section 194.321, RSMo, is repealed, to read as 1
follows:2
[194.321. 1. For purposes of this 1
section, the following terms mean: 2
(1) "COVID-19 vaccination status", an 3
indication of whether a person has received a 4
vaccination against COVID-19; 5
(2) "Hospital", the same meaning given to 6
the term in section 197.020; 7
(3) "Procurement organization", the same 8
meaning given to the term in section 194.210. 9
2. Except if the organ being transplanted 10
is a lung, no hospital, physician, procurement 11
organization, or other person shall consider the 12
COVID-19 vaccination status of a potential organ 13
transplant recipient or potential organ donor in 14
any part of the organ transplant process 15
including, but not limited to: 16
(1) The referral of a patient to be 17
considered for a transplant; 18
(2) The evaluation of a patient for a 19
transplant; 20
(3) The consideration of a patient for 21
placement on a waiting list; 22
(4) A patient's particular position on a 23
waiting list; and 24
(5) The evaluation of a potential donor to 25
determine his or her suitability as an organ 26
donor.] 27
