AN ACT
To amend chapter 167, RSMo, by adding thereto one new section relating to ultraprocessed food
in schools.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Chapter 167, RSMo, is amended by adding thereto 1
one new section, to be known as section 167.207, to read as 2
follows:3
167.207. 1. This section shall be known and may be 1
cited as the "Missouri Healthy Schools Act". 2
2. For the purposes of this section, "ultraprocessed 3
food" means a food or beverage that contains one or more of 4
the following ingredients: 5
(1) Potassium bromate; 6
(2) Propylparaben; 7
(3) Titanium dioxide; 8
(4) Brominated vegetable oil; 9
(5) Yellow dye 5; 10
(6) Yellow dye 6; 11
(7) Blue dye 1; 12
(8) Blue dye 2; 13
(9) Green dye 3; 14
(10) Red dye 3; 15
(11) Red dye 40. 16

3. Beginning in the 2027-2028 school year and for all 17
subsequent school years, any school that participates in a 18
federally funded or assisted meal program shall not serve, 19
sell, or allow a third party to sell ultraprocessed food on 20
the school campus during the school day. This subsection 21
shall not be construed to prohibit a student's parent or 22
guardian from providing ultraprocessed food to the student 23
during the school day. 24
4. The department of elementary and secondary 25
education shall post on the department's website both of the 26
following: 27
(1) A standardized form that a public school may use 28
to certify that the public school is complying with the 29
requirements of this section; and 30
(2) A list of each public school that has certified to 31
the department that the public school is complying with the 32
requirements of this section. 33
