SB 1347 - Under this act, the Director of the Department of Social Services shall request a waiver from the U.S. Department of Agriculture to exclude candy, prepared desserts, and certain beverages from the definition of eligible Supplement Nutrition Assistance Program (SNAP) foods. AN ACT
To amend chapter 208, RSMo, by adding thereto one new section relating to the supplemental
nutrition assistance program.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Chapter 208, RSMo, is amended by adding thereto 1
one new section, to be known as section 208.286, to read as 2
follows:3
208.286. 1. As used in this section, the following 1
terms mean: 2
(1) "Candy", a product that involves the preparation 3
of sugar or artificial sweeteners in combination with 4
chocolate, fruit, nuts, caramels, gummies, hard candies, or 5
other ingredients and flavorings in the form of bars, drops, 6
or pieces; 7
(2) "Certain beverages", shall include the following: 8
(a) Carbonated and noncarbonated soft drinks, 9
including, but not limited to, colas, ginger ale, near-beer, 10
root beer, lemonade, and orangeade; 11
(b) All other drinks or punches with natural fruit or 12
vegetable juice that contain fifty percent or less by volume 13
natural fruit or vegetable juice; 14
(c) Beverage mixes and ingredients intended to be made 15
into taxable beverages; liquid or frozen, concentrated, 16

dehydrated, powdered, granulated, sweetened or unsweetened, 17
or seasoned or unseasoned; or 18
(d) Concentrates intended to be made into beverages 19
that contain fifty percent or less by volume natural fruit 20
or vegetable juice; 21
(3) "Prepared desserts", a processed, shelf-stable, 22
ready-to-eat, prepackaged sweet food intended for immediate 23
consumption without any further preparation, including, but 24
not limited to, foods substantially consisting of chemically 25
modified substances extracted from foods with additives to 26
enhance taste, texture, appearance, and durability and with 27
minimal whole foods. 28
2. The director of the department of social services 29
shall request a waiver from the U.S. Department of 30
Agriculture to exclude candy, prepared desserts, and certain 31
beverages from the definition of eligible foods under 7 CFR 32
271.2. If such waiver is granted, then the director shall 33
prohibit the purchase of candy, prepared desserts, and 34
certain beverages with benefits provided through the 35
supplemental nutrition assistance program. If no waiver is 36
granted, then the director shall annually request a waiver 37
until the waiver is granted. 38
