AN ACT
To amend chapter 324, RSMo, by adding thereto one new section relating to a prohibition on
licensing requirements for certain industrial mechanical maintenance work.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Chapter 324, RSMo, is amended by adding thereto 1
one new section, to be known as section 324.890, to read as 2
follows:3
324.890. 1. As used in this section, the following 1
terms mean: 2
(1) "Contractor", a person who is employed by a 3
corporation, firm, institution, organization, or company to 4
perform industrial mechanical maintenance work; 5
(2) "Establishment", any legally recognized business 6
entity engaged in manufacturing; 7
(3) "Industrial facility", any real property or 8
personal property or fixtures attached to real property at 9
which an establishment engages in a manufacturing activity 10
within an area that, if subject to a zoning ordinance or 11
regulation, is zoned for industrial or similar uses; 12
(4) "Industrial mechanical maintenance work", 13
maintenance of mechanical systems or equipment within an 14
industrial facility; 15
(5) "Local license", a license issued by a political 16
subdivision and valid only in that political subdivision 17

that is required to bid, accept, or perform mechanical work 18
in a political subdivision of this state; 19
(6) "Manufacturing", any activity described in 20
division D of the most recent version of the Standard 21
Industrial Classification Manual; 22
(7) "State license", a license issued by the state of 23
Missouri that is required to bid, accept, or perform 24
mechanical work in this state. 25
2. Any contractor performing industrial mechanical 26
maintenance work employed at an industrial facility shall 27
not be required to obtain a local license or state license 28
to perform industrial mechanical maintenance work for the 29
industrial facility. 30
