SB 1364 - Under this act, any nonprofit statewide association that facilitates interscholastic activities for secondary school students and that includes at least one public school district as a fee-paying member (defined as an "activities association") shall be overseen by a board of three directors appointed by the Governor, by and with the advice and consent of the Senate. The term of office of each director shall be four years. If the General Assembly is not in session when a position on the board of directors becomes vacant, the Governor shall make a temporary appointment.

The board of directors shall have final decision-making power with respect to all actions of an activities association. Upon motion of any party, a matter may be transferred directly to the board at any time during the matter's pendency. Further, the board of directors shall have authority to remove any employee or member of an activities association, with or without cause, at such time and in such manner as the board shall deem proper.

This act contains an emergency clause.

AN ACT
To amend chapter 167, RSMo, by adding thereto one new section relating to statewide activities
associations, with an emergency clause.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Chapter 167, RSMo, is amended by adding thereto 1
one new section, to be known as section 167.795, to read as 2
follows:3
167.795. 1. For purposes of this section, "activities 1
association" shall mean any nonprofit statewide organization 2
that facilitates interscholastic activities for secondary 3
school students, and whose members include at least one 4
public school district that pays any fees to such 5
association, including, but not limited to, activity 6
participation fees, tournament registration fees, membership 7
fees, or any other fees relating to membership in such 8
association or participation in any activities facilitated 9
by such association. 10
2. Notwithstanding any provision of law to the 11
contrary, an activities association shall be overseen by a 12
board of directors appointed by the governor, by and with 13
the advice and consent of the senate. 14
3. The board of directors shall consist of three 15
members. The term of office of each member shall be four 16
years. At the expiration of the term of each member, the 17

governor, by and with the advice and consent of the senate, 18
shall appoint a successor. If the general assembly is not 19
in session at the time for making an appointment, the 20
governor shall make a temporary appointment as in the case 21
of a vacancy. 22
4. The board of directors shall have ultimate 23
authority over, and final decision-making power with respect 24
to, all actions of an activities association. Upon motion 25
of any party, a matter may be transferred directly to the 26
board at any time during such matter's pendency. 27
5. The board of directors shall have authority to 28
remove any employee or member of an activities association, 29
with or without cause, at such time and in such manner as 30
the board shall deem proper. 31
Section B. Due to the physical and mental health 1
challenges faced by minors in the state of Missouri who have 2
been adversely impacted by the actions of activities 3
associations, section A of this act is deemed necessary for 4
the immediate preservation of the public health, welfare, 5
peace, and safety, and is hereby declared to be an emergency 6
act within the meaning of the constitution, and section A of 7
this act shall be in full force and effect upon its passage 8
and approval. 9
