AN ACT
To repeal section 110.240, RSMo, and to enact in lieu thereof one new section relating to county
treasurers.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Section 110.240, RSMo, is repealed and one new 1
section enacted in lieu thereof, to be known as section 110.240, 2
to read as follows:3
110.240. 1. It is the duty of the county treasurer to 1
draw a check as county treasurer upon a county depositary in 2
favor of the legal holder thereof, and to charge the same to 3
the fund upon which it is drawn. No county treasurer shall 4
draw any check upon the funds in any depositary unless there 5
is sufficient money belonging to the fund upon which the 6
check is drawn to pay the same, and no money belonging to 7
the county shall be paid by any depositary except upon 8
checks of the county treasurer. In case any bonds, coupons 9
or other indebtedness of the county are payable by the terms 10
of the bonds, coupons or other debts at any particular place 11
other than the treasury of the county, nothing contained in 12
this section shall prevent any county commission from 13
causing the treasurer to place a sufficient sum at the place 14
where such debts shall be payable, at the time of their 15
maturity, to meet the same. 16

2. As provided in this section and in sections 50.166 17
and 54.140, the county treasurer's signature shall be the 18
only signature authorized or permitted on any bank signature 19
card, deposit agreement, or other authorization document for 20
any account maintained in a county depositary for county 21
funds under the treasurer's custody. No other county 22
official or employee shall be authorized or required to be 23
listed as a signer on any such account. Each county 24
depositary shall ensure compliance with this subsection and 25
shall accept county accounts only in accordance with the 26
signature authority established herein. 27
3. Nothing in this section shall be construed to 28
prohibit any other county officer from maintaining a 29
separate account or accounts specifically authorized by 30
statute for the performance of that officer's official 31
duties. 32
