AN ACT
To repeal section 386.050, RSMo, and to enact in lieu thereof one new section relating to the
commissioners of the public service commission.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Section 386.050, RSMo, is repealed and one new 1
section enacted in lieu thereof, to be known as section 386.050, 2
to read as follows:3
386.050. 1. The commission shall consist of [five] 1
seven members who shall be appointed by the governor, with 2
the advice and consent of the senate, provided that no more 3
than one member shall be appointed from each congressional 4
district, and one of whom shall be designated by the 5
governor to be chair of the commission. At least two 6
members shall be actively engaged in production 7
agriculture. Each commissioner, at the time of the 8
commissioner's appointment and qualification, shall be a 9
resident of the state of Missouri, and shall have resided in 10
the state for a period of at least five years next preceding 11
the appointment and qualification, and shall also be a 12
qualified voter therein and not less than twenty-five years 13
of age. Upon the expiration of each of the terms of office 14
of the first commissioners, the term of office of each 15
commissioner thereafter appointed shall be six years from 16
the time of the commissioner's appointment and qualification 17

and until his successor shall qualify. Vacancies in the 18
commission shall be filled by the governor for the unexpired 19
term. 20
2. As used in this section, "production agriculture" 21
means using or cultivating land for the production of any, 22
any combination, or all of the following for commercial 23
purposes: 24
(1) Agricultural crops; 25
(2) Livestock or livestock products; 26
(3) Poultry or poultry products; 27
(4) Milk or dairy products; 28
(5) Fruit or other horticultural products; or 29
(6) Fish or other aquaculture products. 30
