AN ACT
To repeal section 393.1025, RSMo, and to enact in lieu thereof one new section relating to
renewable energy resources.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Section 393.1025, RSMo, is repealed and one 1
new section enacted in lieu thereof, to be known as section 2
393.1025, to read as follows:3
393.1025. As used in sections 393.1020 to 393.1030, 1
the following terms mean: 2
(1) "Commission", the public service commission; 3
(2) "Department", the department of economic 4
development; 5
(3) "Electric utility", any electrical corporation as 6
defined by section 386.020; 7
(4) "Renewable energy credit" or "REC", a tradeable 8
certificate of proof that one megawatt-hour of electricity 9
has been generated from renewable energy sources; and 10
(5) "Renewable energy resources", electric energy 11
produced from wind, solar thermal sources, photovoltaic 12
cells and panels, nuclear energy sources, hydrogen, 13
dedicated crops grown for energy production, cellulosic 14
agricultural residues, plant residues, methane from 15
landfills, from agricultural operations, or from wastewater 16
treatment, thermal depolymerization or pyrolysis for 17

converting waste material to energy, clean and untreated 18
wood such as pallets, hydropower (not including pumped 19
storage) that does not require a new diversion or 20
impoundment of water and that has a nameplate rating of ten 21
megawatts or less, fuel cells using hydrogen produced by one 22
of the above-named renewable energy sources, and other 23
sources of energy [not including nuclear] that become 24
available after November 4, 2008, and are certified as 25
renewable by rule by the department. 26
