AN ACT
To amend chapter 288, RSMo, by adding thereto two new sections relating to unemployment
administration adjustments.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Chapter 288, RSMo, is amended by adding thereto 1
two new sections, to be known as sections 288.135 and 288.136, 2
to read as follows:3
288.135. 1. This is hereby created in the state 1
treasury the "Unemployment Administration Adjustment Fund", 2
which shall consist of money collected pursuant to section 3
288.136, and such other state funds appropriated by the 4
general assembly. The state treasurer shall be custodian of 5
the fund and may approve disbursements from the fund in 6
accordance with sections 30.170 and 30.180. Upon 7
appropriation, money in the fund shall be used solely for 8
the purpose of defraying the cost of the administration of 9
this law, and for no other purpose whatsoever. 10
Notwithstanding the provisions of section 33.080 to the 11
contrary, all moneys remaining in the fund at the end of the 12
biennium shall not revert to the credit of the general 13
revenue fund. The state treasurer shall invest moneys in 14
the fund in the same manner as other funds are invested. 15
Any interest and money earned on such investments shall be 16
credited to the fund. 17

2. The unemployment administration adjustment fund 18
shall not be used in whole or in part for any purpose or in 19
any manner that would permit its substitution for, or a 20
corresponding reduction in, federal funds that would be 21
available in its absence to finance expenditures for the 22
administration of this chapter, or cause the appropriate 23
agency of the United States government to withhold any part 24
of an administrative grant which would otherwise be made. 25
288.136. 1. Each employer liable for contributions 1
pursuant to this chapter, except employers with a 2
contribution rate equal to zero, shall pay an annual 3
unemployment administration adjustment in an amount equal to 4
five one-hundredths of one percent of such employer's total 5
taxable wages for the twelve-month period ending the 6
preceding June thirtieth. 7
2. Notwithstanding subsection 1 of this section to the 8
contrary, when the September thirtieth balance of the 9
unemployment administration adjustment fund is forty million 10
dollars or more, or if the average balance of the 11
unemployment compensation trust fund of the four preceding 12
quarters (September thirtieth, June thirtieth, March thirty- 13
first, December thirty-first) is less than four hundred 14
fifty million dollars, no unemployment administration 15
adjustment shall be applied in the succeeding calendar year. 16
3. Each employer liable to pay an unemployment 17
administration adjustment shall be notified of the amount 18
due under this section by March thirty-first of each year 19
and such amount shall be considered delinquent thirty days 20
thereafter. Delinquent unemployment administration 21
adjustment amounts may be collected in the manner provided 22
under sections 288.160 and 288.170. All moneys collected 23
under this section shall be deposited in the unemployment 24

administration adjustment fund established in section 25
288.135. 26
4. For the first quarter of each calendar year, the 27
total amount of contribution otherwise due from each 28
employer liable to pay contributions under this chapter 29
shall be reduced by the dollar amount due from such employer 30
pursuant to the calculation in subsection 1 of this 31
section. However, the amount of contributions due from such 32
employer for the first quarter of the calendar year in 33
question shall not be reduced below zero. 34
