AN ACT
To repeal section 286.010, RSMo, and to enact in lieu thereof one new section relating to the labor
and industrial relations commission.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Section 286.010, RSMo, is repealed and one new 1
section enacted in lieu thereof, to be known as section 286.010, 2
to read as follows:3
286.010. There is hereby created and established a 1
separate department of the state government to be known as 2
"The Department of Labor and Industrial Relations". Such 3
department shall be under the control, management and 4
supervision of a commission to be known and designated as 5
"The Labor and Industrial Relations Commission of 6
Missouri". Such commission shall consist of [three] five 7
members, each of whom shall have resided in this state for 8
at least five years immediately prior to the person's 9
appointment, to be appointed by the governor, by and with 10
the advice and consent of the senate. One member of the 11
commission shall be a person who, on account of the person's 12
previous vocation, employment, affiliation or interests 13
shall be classified as a representative of employers, and 14
one member who, on account of the person's previous 15
vocation, employment, affiliation or interests shall be 16
classified as a representative of employees, and one member, 17

who, by reason of the person's previous activities and 18
interests shall be classified as a representative of the 19
public and who is licensed to practice law in the state of 20
Missouri; provided, however, that not more than [two] three 21
members of the commission shall be of the same political 22
party. A member of the commission shall be designated by 23
the governor as the chairman of the commission. During the 24
member's term of membership on the commission, no member 25
shall engage in any other business, vocation or employment, 26
or serve as an officer or committee member of any political 27
party or organization. Any [two] three commissioners shall 28
constitute a quorum. The governor shall fill any vacancy 29
within sixty days but no vacancy shall impair the right of 30
the remaining commissioners to exercise all powers of the 31
commission. 32
