SB 1438 - This act modifies the required amount of motor vehicle liability insurance. The required amount of coverage for bodily injury or death is increased from $25,000 to $50,000 for one person, and from $50,000 to $100,000 for bodily injury or death to two or more persons in any one accident, and from $25,000 to $50,000 for injury to or destruction of property of others in any one accident. Currently, any underinsured motor vehicle coverage with less than two times the limits for bodily injury or death under current law shall be construed to provide coverage in excess of the liability coverage of any underinsured motor vehicle involved in the accident. This act provides that any underinsured motor vehicle coverage shall be construed to provide coverage in excess of the liability coverage of any motor vehicle involved in the accident.
