AN ACT
To amend chapter 49, RSMo, by adding thereto one new section relating to the demolition of
certain public facilities.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Chapter 49, RSMo, is amended by adding thereto 1
one new section, to be known as section 49.710, to read as 2
follows:3
49.710. 1. As used in this section, the following 1
terms shall mean: 2
(1) "Costs of demolition", costs incurred for any 3
operation by which a public facility is wrecked, razed, 4
rendered, moved, or removed by means of any tools, 5
equipment, or discharge of explosives. "Costs of 6
demolition" shall include any costs incurred for the removal 7
of all infrastructure including roads, sewers, or any other 8
similar infrastructure, as well as the costs of any required 9
environmental cleanup associated with the demolition; 10
(2) "Public facility", any building or facility owned 11
by: 12
(a) A county, a municipality, or a city not within a 13
county; or 14
(b) Any authority, board, commission, or other 15
political subdivision created by or pursuant to state law 16

for the purpose of owning or operating public facilities on 17
behalf of one or more counties or municipalities. 18
2. Any lessee of a public facility located in this 19
state with a capacity of sixty thousand people or more, at 20
which one or more professional sports teams plays its home 21
games, shall be liable for the reasonable costs of 22
demolition of such public facility if, upon termination or 23
expiration of the lease, the public facility is left in a 24
condition that is not reasonably adaptable or usable for 25
another lawful public or commercial use. 26
