AN ACT
To amend chapter 386, RSMo, by adding thereto one new section relating to electric service
interruption.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Chapter 386, RSMo, is amended by adding thereto 1
one new section, to be known as section 386.1000, to read as 2
follows:3
386.1000. 1. As used in this section, the following 1
terms mean: 2
(1) "Commission", the Missouri public service 3
commission; 4
(2) "Electrical corporation", the same as defined in 5
section 386.020; 6
(3) "Electric service interruption", an interruption 7
in electric service to a customer if such electric service 8
interruption was not caused by a customer; 9
(4) "Loss", any financial loss a customer incurs as a 10
result of an electric service interruption, including, but 11
not limited to, food, medicine, or any other good; 12
(5) "Rate", the same as defined in section 386.020. 13
2. Whenever an electric service interruption occurs 14
that lasts for more than forty-eight hours, and a customer 15
incurs a loss as a result of such electric service 16

interruption, an electrical corporation shall reimburse the 17
customer for the loss from the electric service interruption. 18
3. An electrical corporation shall create a form for 19
loss recovery and make the form available on the electrical 20
corporation's website. 21
4. If a loss is greater than two hundred dollars, a 22
customer shall submit receipts or any relevant documents for 23
such loss with the form as provided in subsection 3 of this 24
section to the electrical corporation before being 25
reimbursed for the loss by the electrical corporation. 26
5. The commission shall require an electrical 27
corporation to maintain a record detailing each instance a 28
transmission of electricity is less than fifty percent of 29
the standard voltage or whenever an electric service 30
interruption affects more than ten customers. The record 31
shall not include disconnection of service to customers for 32
good cause. The record shall include: 33
(1) Date, time, and duration of an electric service 34
interruption; 35
(2) Number of customers affected by an electric 36
service interruption; 37
(3) Description of the cause of an electric service 38
interruption, including any equipment involved in the 39
electric service interruption, if applicable; 40
(4) The geographic area of an electric service 41
interruption; 42
(5) Measures taken by an electrical corporation to 43
restore electric service; 44
(6) Measures taken by an electrical corporation to 45
prevent future electric service interruptions; and 46

(7) Amounts paid by an electrical corporation to 47
affected customers for any loss incurred as a result of an 48
electric service interruption. 49
6. Copies of any records detailing the information 50
required in subsection 5 of this section shall be made 51
public by an electrical corporation on the electrical 52
corporation's website. 53
7. The commission shall promulgate rules to ensure 54
compliance with provisions of this section. Any rule or 55
portion of a rule, as that term is defined in section 56
536.010, that is created under the authority delegated in 57
this section shall become effective only if it complies with 58
and is subject to all of the provisions of chapter 536 and, 59
if applicable, section 536.028. This section and chapter 60
536 are nonseverable and if any of the powers vested with 61
the general assembly pursuant to chapter 536 to review, to 62
delay the effective date, or to disapprove and annul a rule 63
are subsequently held unconstitutional, then the grant of 64
rulemaking authority and any rule proposed or adopted after 65
August 28, 2026, shall be invalid and void. 66
