AN ACT
To amend chapter 192, RSMo, by adding thereto one new section relating to noncommunicable
disease surveillance.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Chapter 192, RSMo, is amended by adding thereto 1
one new section, to be known as section 192.037, to read as 2
follows:3
192.037. 1. The department of health and senior 1
services shall designate noncommunicable diseases that are 2
of public health concern and enforce adequate orders, 3
findings, rules, and regulations to prevent the spread of 4
such diseases and to determine the prevalence of such 5
diseases within the state. 6
2. The department of health and senior services shall 7
include in its list of noncommunicable diseases that are 8
required to be reported to the department alpha-gal syndrome 9
and Lyme disease. 10
3. Any required noncommunicable disease case report 11
shall be submitted to the department within seven days of 12
receiving a positive laboratory confirmation. The person or 13
entity responsible for submitting the report shall be: 14
(1) For any case other than a case of alpha-gal 15
syndrome, the health care provider treating the patient; and 16

(2) For any case of alpha-gal syndrome, the laboratory 17
that finalizes the positive test result. 18
4. A report of alpha-gal syndrome shall be required 19
for an alpha-gal immunoglobulin E level of greater than or 20
equal to one-tenth of one international unit per milliliter 21
or greater than or equal to one-tenth of one kilounit per 22
liter. A laboratory that finalizes such a test result shall 23
report the test result as a case of alpha-gal syndrome using 24
an electronic laboratory reporting system to be developed by 25
the department. 26
5. The department of health and senior services shall 27
follow up on reported cases of alpha-gal syndrome by 28
applying an appropriate random sampling method for 29
confirmation that the cases meet the most current Centers 30
for Disease Control and Prevention surveillance case 31
definition of alpha-gal syndrome. 32
6. The department of health and senior services shall 33
submit an annual report to the Centers for Disease Control 34
and Prevention summarizing its findings related to the 35
reporting and incidence of the diseases included in the list 36
described in subsection 2 of this section. 37
7. Any rule or portion of a rule, as that term is 38
defined in section 536.010, that is created under the 39
authority delegated in this section shall become effective 40
only if it complies with and is subject to all of the 41
provisions of chapter 536 and, if applicable, section 42
536.028. This section and chapter 536 are nonseverable and 43
if any of the powers vested with the general assembly 44
pursuant to chapter 536 to review, to delay the effective 45
date, or to disapprove and annul a rule are subsequently 46
held unconstitutional, then the grant of rulemaking 47

authority and any rule proposed or adopted after August 28, 48
2026, shall be invalid and void. 49
