AN ACT
To repeal section 160.425, RSMo, and to enact in lieu thereof one new section relating to the
Missouri charter public school commission.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Section 160.425, RSMo, is repealed and one new 1
section enacted in lieu thereof, to be known as section 160.425, 2
to read as follows:3
160.425. 1. The "Missouri Charter Public School 1
Commission" is hereby created within the department of 2
elementary and secondary education with the authority to 3
sponsor high quality charter schools throughout the state of 4
Missouri. 5
2. The commission shall consist of nine members 6
appointed by the [governor, by and with the advice and 7
consent of the senate] state board of education. No more 8
than five of the members shall be of the same political 9
party. No more than two members shall be from the same 10
congressional district. The term of office of each member 11
shall be four years, except those of the members first 12
appointed, of which three shall be appointed for a term of 13
one year, two for a term of two years, two for a term of 14
three years, and two for a term of four years. At the 15
expiration of the term of each member, the [governor, by and 16

with the advice and consent of the senate,] state board of 17
education shall appoint a successor. 18
3. [The appointees to the commission shall be selected 19
as follows: 20
(1) One member selected by the governor from a slate 21
of three recommended by the commissioner of education; 22
(2) One member selected by the governor from a slate 23
of three recommended by the commissioner of higher education; 24
(3) One member selected by the governor from a slate 25
of three recommended by the president pro tempore of the 26
senate; 27
(4) One member selected by the governor from a slate 28
of three recommended by the speaker of the house of 29
representatives; and 30
(5) Five additional members appointed by the governor, 31
one of whom shall be selected from a slate of three nominees 32
recommended by the Missouri School Boards Association. 33
4.] Members appointed to the commission shall 34
collectively possess strong experience and expertise in 35
governance, management and finance, school leadership, 36
assessment, curriculum and instruction, and education law. 37
All members of the commission shall have demonstrated 38
understanding of and commitment to charter schooling as a 39
strategy for strengthening public education. 40
[5.] 4. The commission shall annually elect a 41
chairperson and vice chairperson, who shall act as 42
chairperson in his or her absence. The commission shall 43
meet at the call of the chairperson. The chairperson may 44
call meetings at such times as he or she deems advisable and 45
shall call a meeting when requested to do so by three or 46
more members of the commission. Members of the commission 47
are not eligible to receive compensation. 48

[6.] 5. The commission may approve proposed charters 49
for its sponsorship under sections 160.400 to 160.425 and 50
shall: 51
(1) Comply with all of the requirements applicable to 52
sponsors under sections 160.400 to 160.425; 53
(2) Exercise sponsorship over charters approved by the 54
commission under sections 160.400 to 160.425, including 55
receipt of sponsorship funding under subsection 11 of 56
section 160.400. Sponsorship funding due to the commission 57
shall be deposited to the credit of the charter public 58
school commission revolving fund created pursuant to this 59
section. 60
[7.] 6. Charter schools sponsored by the commission 61
shall comply with all of the requirements applicable to 62
charter schools under sections 160.400 to 160.425. 63
[8.] 7. The commission shall conduct its business in 64
accordance with chapter 610. 65
[9.] 8. The department of elementary and secondary 66
education shall provide start-up funding for the commission 67
to operate. The commission shall reimburse the department's 68
costs from any funds it receives as sponsor under section 69
160.400. 70
[10.] 9. The commission is authorized to receive and 71
expend gifts, grants, and donations of any kind from any 72
public or private entity to carry out the purposes of 73
sections 160.400 to 160.425, subject to the terms and 74
conditions under which they are given, provided that all 75
such terms and conditions are permissible under law. 76
[11.] 10. There is hereby created in the state 77
treasury the "Charter Public School Commission Revolving 78
Fund", which shall consist of moneys collected under this 79
section. The state treasurer shall be custodian of the 80

fund. In accordance with sections 30.170 and 30.180, the 81
state treasurer may approve disbursements. Notwithstanding 82
the provisions of section 33.080 to the contrary, any moneys 83
remaining in the fund at the end of the biennium shall not 84
revert to the credit of the general revenue fund. The state 85
treasurer shall invest moneys in the fund in the same manner 86
as other funds are invested. Subject to appropriation, 87
moneys in the fund shall be used solely for the 88
administration of this section. 89
