AN ACT
To repeal sections 620.580, 620.582, 620.584, 620.586, 620.588, 620.590, and 620.592, RSMo,
and to enact in lieu thereof seven new sections relating to the Missouri community
service commission.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Sections 620.580, 620.582, 620.584, 620.586, 1
620.588, 620.590, and 620.592, RSMo, are repealed and seven new 2
sections enacted in lieu thereof, to be known as sections 3
173.4000, 173.4002, 173.4004, 173.4006, 173.4008, 173.4010, and 4
173.4012, to read as follows:5
[620.580.] 173.4000. Sections [620.580] 173.4000 to 1
[620.592] 173.4012 shall be known and may be cited as the 2
"Missouri Community Service Act". 3
[620.582.] 173.4002. As used in sections [620.580] 1
173.4000 to [620.592] 173.4012, the following terms mean: 2
(1) "Act", the national and community service act of 3
1990, as amended; 4
(2) "Commission", the Missouri community service 5
commission created by sections [620.580] 173.4000 to 6
[620.592] 173.4012; 7
(3) "Community service programs", the performance of 8
tasks designed primarily to address educational, public 9
safety, human, or environmental needs at a local, regional, 10
state, or multistate level; 11

(4) "Corporation", the corporation for national and 12
community service authorized by the act; 13
(5) "National service laws", the act and other federal 14
legislation that authorizes or may authorize community 15
service activities in states; 16
(6) "National service position", a placement in a 17
community service program whereby an individual may earn an 18
educational award, as authorized by the act. 19
[620.584.] 173.4004. 1. The Missouri community 1
service commission is assigned to the department of 2
[economic development] higher education and workforce 3
development. 4
2. The commission is established to make community 5
service the common expectation and experience of all 6
Missourians with a special concentration on Missouri's young 7
people. The commission shall focus its efforts primarily on 8
issues related to education, public safety, human needs, and 9
the environment. 10
3. The commission shall work to renew the ethic of 11
civic responsibility in Missouri and to involve and enroll 12
citizens in service opportunities that benefit Missouri 13
while offering citizens skills that can be used to further 14
their own plans for education, for a career, or for 15
continuing community services. The commission shall build 16
on the existing organizational framework of state, local, 17
and community-based programs and agencies to expand full- 18
time and part-time service opportunities for all citizens, 19
but particularly Missouri's youth. 20
[620.586.] 173.4006. 1. The commission shall include 1
at least fifteen, but no more than nineteen, voting members 2
appointed by the governor with the advice and consent of the 3

senate. The commission shall include the following voting 4
members: 5
(1) A representative of local government; 6
(2) The commissioner of the department of elementary 7
and secondary education or the designee of such person; 8
(3) An individual with experience in promoting the 9
involvement of older adults in service and volunteerism; 10
(4) A representative of a national service program; 11
(5) An individual with expertise in the educational, 12
training, and development needs of youth, particularly 13
disadvantaged youth; 14
(6) An individual between the ages of sixteen and 15
twenty-five years who is a participant in or supervisor of a 16
service program for school-age youth, or a campus-based or 17
national service program; 18
(7) A representative of community-based agencies or 19
organizations in the state; 20
(8) A representative of labor organizations; 21
(9) A member representing the business community; 22
(10) The lieutenant governor or his or her designee; 23
(11) A representative of the volunteer sector; and 24
(12) Between four and eight other members, appointed 25
by the governor, provided that no more than twenty percent 26
of the voting members are officers or employees of the 27
state, and provided further that not more than fifty percent 28
plus one of the voting members of the commission are members 29
of the same political party. 30
2. The commission shall include at least one 31
nonvoting, ex officio member who shall be a representative 32
from the corporation for national and community service. 33
The governor may appoint any number of other nonvoting, ex 34

officio members who shall serve at the pleasure of the 35
governor. 36
3. Appointments to the commission shall reflect the 37
race, ethnicity, age, gender, and disability characteristics 38
of the population of the state as a whole. 39
4. Voting members shall serve renewable terms of three 40
years, except that of the first members appointed, one-third 41
shall serve for a term of one year, one-third shall serve 42
for a term of two years, and one-third shall serve for a 43
term of three years. If a commission vacancy occurs, the 44
governor shall appoint a new member to serve for the 45
remainder of the unexpired term. Vacancies shall not affect 46
the power of the remaining members to execute the 47
commission's duties. 48
5. The members of the commission shall receive no 49
compensation for their services on the commission, but shall 50
be reimbursed for ordinary and necessary expenses incurred 51
in the performance of their duties. 52
6. The voting members of the commission shall elect 53
one of their members to serve as chairperson of the 54
commission. The voting members may elect such other 55
officers as deemed necessary. 56
7. The commission shall meet at least quarterly. 57
[620.588.] 173.4008. 1. The commission shall have the 1
following powers and duties: 2
(1) To ensure that its funding decisions meet all 3
federal and state statutory requirements; 4
(2) To prepare for this state an annual national 5
service plan that follows state and federal guidelines; 6
(3) To recommend innovative statewide service programs 7
to increase volunteer participation and community-based 8

problem solving by all age groups and among diverse 9
participants; 10
(4) To utilize local, state, and federal resources to 11
initiate, strengthen, and expand quality service programs; 12
(5) To promote interagency collaboration to maximize 13
resources and develop a model of such collaboration on the 14
state level; 15
(6) To oversee the application process to apply for 16
corporation grants and funds, and for approval of service 17
positions; 18
(7) To establish priorities, policies, and procedures 19
for the use of funds received under national service laws 20
and for funds deposited into the community service 21
commission fund established in section [620.592] 173.4012; 22
(8) To provide technical assistance for applicants to 23
plan and implement service programs and to apply for 24
assistance under the national service laws; 25
(9) To solicit and accept gifts, contributions, 26
grants, bequests, or other aid from any person, business, 27
organization or foundation, public or private, and from 28
federal, state or local government or any agency of federal, 29
state or local government. 30
2. The commission shall have other powers and duties 31
in addition to those listed in subsection 1 of this section, 32
including: 33
(1) To utilize staff within the department of 34
[economic development] higher education and workforce 35
development, the office of a designated statewide elected 36
official, or other executive departments as needed for this 37
purpose; and 38

(2) To enter into contracts with individuals, 39
organizations, and institutions within amounts available for 40
this purpose. 41
[620.590.] 173.4010. 1. All state agencies, the 1
University of Missouri extension system, and any unit of 2
local government, including school districts, may share 3
information and cooperate with the commission to enable it 4
to perform the functions assigned to it by state and federal 5
law. 6
2. Any state agency that operates or plans to 7
establish a community service program may coordinate its 8
efforts with the commission. 9
[620.592.] 173.4012. 1. There is hereby created in 1
the state treasury the "Community Service Commission Fund". 2
The state treasurer shall deposit to the credit of the fund 3
all moneys which may be appropriated to it by the general 4
assembly and also any gifts, contributions, grants, 5
bequests, or other aid received from federal, private, or 6
other sources. The general assembly may appropriate moneys 7
into the fund for the support of the commission and its 8
activities. Notwithstanding the provisions of section 9
33.080 to the contrary, moneys in the fund shall not revert 10
to the credit of the general revenue fund at the end of the 11
biennium. 12
2. The commission shall submit an annual report of its 13
activities to the speaker of the house of representatives, 14
the president pro tem of the senate, and the governor before 15
January thirty-first of each year. 16
