SB 1782 - This act establishes "Justin's Law". The Director of the Department of Public Safety shall establish the Illicit Narcotics Canine Committee (INCC). The primary purpose of the INCC is to review applicants and award funds for illicit narcotics canine programs. This committee shall also create a list of approved kennels that programs can choose from when purchasing a canine. The INCC shall consist of nine members that shall be appointed by the Director.

This act authorizes police or county sheriff departments to establish an illicit narcotics canine program within the department. A program established under this provision must use law enforcement dogs that have been trained to detect illicit narcotics. In addition, all law enforcement canine and handler teams must be accredited by certain entities. Further, all canine and handler teams shall train for at least sixteen hours per month with criteria established by the INCC. This act requires that each program submit statistics no less than quarterly into Packtrack or a similar record management software system.

This act establishes the Illicit Narcotics Canine Fund which is administered by the Department of Public Safety. Under this act, the General Assembly shall appropriate five hundred thousand dollars to this fund every year. Police or county sheriff departments that establish or operate an illicit narcotics canine program may apply for a grant of no more than thirty five thousand dollars. These grants can be used to cover the cost of certain law enforcement canine-related expenses, except for the purchase of vehicles and salaries.

AN ACT
To amend chapters 85 and 590, RSMo, by adding thereto two new sections relating to the use of
canines by law enforcement agencies.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Chapters 85 and 590, RSMo, are amended by 1
adding thereto two new sections, to be known as sections 85.025 2
and 590.220, to read as follows:3
85.025. 1. This section and section 590.220 shall be 1
known as "Justin's Law". 2
2. The director of the department of public safety or 3
his or her designee shall establish the "Illicit Narcotics 4
Canine Committee" (INCC). The INCC shall work in 5
coordination with the Missouri Police Chiefs Association, 6
the Missouri Sheriff's Association, and other law 7
enforcement entities as appropriate and necessary. The 8
primary purpose of the INCC shall be to review applicants 9
and award funds for the requested programs. The INCC shall 10
have nine members appointed by the director and shall 11
consist of: 12
(1) Two members from the department of public safety 13
or Missouri state highway patrol; 14
(2) Two members from the Missouri Police Chiefs 15
Association; 16

(3) Two members from the Missouri Sheriff's 17
Association; 18
(4) Two canine officers; and 19
(5) One narcotics officer or detective. 20
3. Any police or county sheriff department may 21
establish a canine program within their department with the 22
primary purpose of illicit narcotic detection. 23
4. Any program established by a police department or 24
county sheriff department under this section shall utilize 25
law enforcement canines that have been trained to detect 26
illicit narcotics. 27
5. All law enforcement dogs and handlers shall be 28
fully certified as a team by one of the following accredited 29
entities: 30
(1) North American Police Work Dog Association; 31
(2) International Police Work Dog Association; 32
(3) American Mantrailing, Police & Work Dog 33
Association; 34
(4) Missouri Police Canine Association; 35
(5) United States Police Canine Association; or 36
(6) Any other approved certification deemed 37
satisfactory by the INCC. 38
6. A police or county sheriff department that 39
establishes or operates a program under this section shall 40
have the authority to select from which kennel to purchase 41
their canine, as long as those vendors are on the approved 42
list designated by the INCC as certified vendors. 43
7. A police or county sheriff department that 44
establishes or operates a program under this section may 45
apply for a grant from the illicit narcotics canine fund in 46
section 590.220 to cover certain law enforcement dog-related 47
expenses. 48

8. Each department shall submit statistics no less 49
than quarterly into Packtrack or a similar law enforcement 50
dog record management software system. 51
590.220. 1. There is hereby established in the state 1
treasury the "Illicit Narcotics Canine Fund" which shall 2
consist of moneys collected under this section. The state 3
treasurer shall be custodian of the fund. In accordance 4
with sections 30.170 and 30.180, the state treasurer may 5
approve disbursements. The fund shall be a dedicated fund 6
and, upon appropriation, moneys in the fund shall be used 7
solely to provide grants for the establishment and operation 8
of the illicit narcotics canine committee under section 9
85.025. 10
2. The fund shall consist of five hundred thousand 11
dollars appropriated annually by the general assembly as 12
well as moneys received from private sources, gifts, and 13
donations. Notwithstanding the provisions of section 33.080 14
to the contrary, any moneys remaining in the fund at the end 15
of the biennium shall not revert to the credit of the 16
general revenue fund. 17
3. The state treasurer shall invest moneys in the fund 18
in the same manner as other funds are invested. Any 19
interest and moneys earned on such investments shall be 20
credited to the fund. 21
4. The department of public safety in collaboration 22
with the illicit narcotics canine committee established in 23
section 85.025 shall issue grants of no more than thirty- 24
five thousand dollars to police or county sheriff 25
departments for the establishment of illicit narcotics 26
canine programs under section 85.025. The grants shall be 27
used for: 28
(1) The purchase of a law enforcement dog; 29

(2) Training for the law enforcement dog or the 30
handler; 31
(3) A kennel build-out for officer vehicles; 32
(4) A kennel at the officer's residence; 33
(5) A kennel at the police or sheriff department; 34
(6) Training aids; 35
(7) Veterinary bills; 36
(8) Medical insurance; and 37
(9) Other equipment deemed necessary by the illicit 38
narcotics canine committee. 39
5. If a grant is received by a police or county 40
sheriff department, vehicles for law enforcement canines 41
shall be equipped with a heat alarm. All law enforcement 42
canines funded under this section shall have department-paid 43
medical insurance for the duration of the law enforcement 44
canine's working life. 45
6. Grants disbursed under this section shall not be 46
used for the purchase of vehicles or salaries. 47
7. Every canine and canine handler shall train, at a 48
minimum, at least sixteen hours per month with criteria 49
established by the INCC. 50
