SB 1792 - This act establishes the "Pay Us Back Act".

The act requires the Commissioner of the Office of Administration to determine the total amount of football-related public benefits, as defined in the act, received by any professional sports team affiliated with or franchised by the National Football League that leases a sports facility receiving state appropriations. For all calendar years beginning on or after January 1, 2027, and ending on or before December 31, 2031, such professional sports team shall, for the purpose of reimbursing the state for such football-related public benefits, annually remit to the Department of Revenue an amount equal to one-fifth of the total football-related public benefits, which shall be deposited in the "Sports Facility Remediation Fund", which is created by the act.

Seventy-five percent of the moneys in the Sports Facility Remediation Fund shall be used solely for the demolition or conversion of a sports facility that has received state appropriations in order for such facility to be economically developed and put to another lawful public or commercial use. The remaining twenty-five percent of the moneys in the Sports Facility Remediation Fund shall be appropriated to the Department of Health and Senior Services for the purposes of conducting research on the causes and effects of chronic traumatic encephalopathy (CTE).

The total amount of reimbursements received pursuant to this act shall not exceed the total amount of football-related public benefits.

AN ACT
To amend chapter 67, RSMo, by adding thereto one new section relating to certain convention and
sports complex funds.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Chapter 67, RSMo, is amended by adding thereto 1
one new section, to be known as section 67.647, to read as 2
follows:3
67.647. 1. The provisions of this section shall be 1
known and may be cited as the "Pay Us Back Act". 2
2. As used in this section, the following terms shall 3
mean: 4
(1) "Commissioner", the commissioner of the office of 5
administration; 6
(2) "Football-related public benefits", the sum of: 7
(a) Fifty percent of the total amount of 8
appropriations made to a convention and sports complex fund 9
pursuant to section 67.641, as adjusted for inflation; 10
(b) Fifty percent of the total amount of tax credits 11
issued for the benefit of a sports facility receiving state 12
appropriations pursuant to sections 67.638 to 67.646; 13
(c) The total amount of tax credits issued for the 14
benefit of any practice, training, or other facility owned 15
or utilized by any professional sports team affiliated with 16
or franchised by the National Football League that leases a 17

sports facility receiving state appropriations pursuant to 18
sections 67.638 to 67.646; and 19
(d) The total amount of any other tax credits or other 20
public benefits awarded to or on behalf of any professional 21
sports team affiliated with or franchised by the National 22
Football League that leases a sports facility receiving 23
state appropriations pursuant to sections 67.638 to 67.646. 24
3. By no later than December 31, 2026, the 25
commissioner shall determine and report to the general 26
assembly and the governor the total amount of football- 27
related public benefits received by any professional sports 28
team affiliated with or franchised by the National Football 29
League that leases a sports facility receiving state 30
appropriations pursuant to sections 67.638 to 67.646. For 31
all calendar years beginning on or after January 1, 2027, 32
and ending on or before December 31, 2031, such professional 33
sports team shall, for the purpose of reimbursing the state 34
for football-related public benefits, annually remit to the 35
department of revenue an amount equal to one-fifth of the 36
total football-related public benefits, as determined by the 37
commissioner, which shall be deposited in the "Sports 38
Facility Remediation Fund", which is hereby established in 39
the state treasury. The state treasurer shall be custodian 40
of the fund. In accordance with sections 30.170 and 30.180, 41
the state treasurer may approve disbursements. 42
Notwithstanding the provisions of section 33.080 to the 43
contrary, any moneys remaining in the fund at the end of the 44
biennium shall not revert to the credit of the general 45
revenue fund. The state treasurer shall invest moneys in 46
the fund in the same manner as other funds are invested. 47
Any interest and moneys earned on such investments shall be 48
credited to the fund. 49

received appropriations pursuant to sections 67.638 to 53
67.646 in order for such facility to be economically 54

sports facility remediation fund shall be appropriated to 57
