SB 867 - This act requires certain financial information regarding the Missouri Empowerment Scholarship Accounts Program (MOScholars) to be posted semi-annually on the Missouri Accountability Portal.

Specifically, the Portal shall include the following information:
(1) The full name of each parent of a student who receives a scholarship from each educational assistance organization;
(2) The total amount of money awarded to each parent's student; and
(3) The total amount of money remitted from each scholarship account to each qualified school.

AN ACT
To repeal section 37.850, RSMo, and to enact in lieu thereof one new section relating to
accessibility of certain educational financial information on the state accountability
portal.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Section 37.850, RSMo, is repealed and one new 1
section enacted in lieu thereof, to be known as section 37.850, 2
to read as follows:3
37.850. 1. The commissioner of administration shall 1
maintain the Missouri accountability portal established in 2
executive order 07-24 as a free, internet-based tool 3
allowing citizens to demand fiscal discipline and 4
responsibility. 5
2. The Missouri accountability portal shall consist of 6
an easy-to-search database of the following information: 7
(1) Financial transactions related to the purchase of 8
goods and services and the distribution of funds for state 9
programs; 10
(2) All bonds issued by any public institution of 11
higher education or political subdivision of this state or 12
its designated authority after August 28, 2013; 13
(3) All obligations issued or incurred pursuant to 14
section 99.820 by any political subdivision of this state or 15
its designated authority; [and] 16

(4) The revenue stream pledged to repay such bonds or 17
obligations; [and] 18
(5) All debt incurred by any public charter school; and 19
(6) The following financial information relating to 20
the Missouri empowerment scholarship accounts program 21
established in sections 135.712 to 135.719 and sections 22
166.700 to 166.720: 23
(a) The full name of the parent of each qualified 24
student for whom an empowerment scholarship account was 25
opened with each educational assistance organization; 26
(b) The total amount of money that has been awarded 27
from each educational assistance organization to each 28
parent's student, both by school year and the total 29
aggregate amount; and 30
(c) The total amount of money that has been remitted 31
from the empowerment scholarship account of each parent's 32
student to each qualified school, both by school year and 33
the total aggregate amount. 34
3. The Missouri accountability portal shall be updated 35
each state business day and maintained as the primary source 36
of information about the activity of Missouri's government. 37
4. Upon the conducting of a withholding or a release 38
of funds, the governor shall submit a report stating all 39
amounts withheld from the state's operating budget for the 40
current fiscal year, as authorized by Article IV, Section 27 41
of the Missouri Constitution which shall be: 42
(1) Conspicuously posted on the accountability portal 43
website; 44
(2) Searchable by the amounts withheld or released 45
from each individual fund; and 46
(3) Searchable by the total amount withheld or 47
released from the operating budget. 48

5. Every political subdivision of the state, including 49
public institutions of higher education but excluding school 50
districts, shall supply all information described in 51
subsection 2 of this section to the office of administration 52
within seven days of issuing or incurring such corresponding 53
bond or obligation. For all such bonds or obligations 54
issued or incurred prior to August 28, 2013, every such 55
political subdivision and public institution of higher 56
education shall have ninety days to supply such information 57
to the office of administration. 58
6. Every school district and public charter school 59
shall supply all information described in subsection 2 of 60
this section to the department of elementary and secondary 61
education within seven days of issuing such bond, or 62
incurring such debt. The department of elementary and 63
secondary education shall have forty-eight hours to deliver 64
such information to the office of administration. For all 65
such bonds issued or debt incurred prior to August 28, 2013, 66
every school district and public charter school shall have 67
ninety days to supply such information to the department of 68
elementary and secondary education. The department of 69
elementary and secondary education shall have forty-eight 70
hours to deliver such information to the office of 71
administration. 72
7. Each educational assistance organization shall 73
supply all information described in subsection 2 of this 74
section to the state treasurer no later than July first and 75
January first of each year. The state treasurer shall have 76
forty-eight hours to deliver such information to the office 77
of administration. 78
