AN ACT
To amend chapter 304, RSMo, by adding thereto one new section relating to vehicle weight limits.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Chapter 304, RSMo, is amended by adding thereto 1
one new section, to be known as section 304.173, to read as 2
follows:3
304.173. 1. As used in this section, the following 1
terms mean: 2
(1) "Construction materials", materials intended for 3
use in a construction project, including, but not limited 4
to, asphalt, concrete, and aggregates; 5
(2) "Interstate system", that portion of the national 6
system of interstate highways located within the boundaries 7
of Missouri, as officially designated or may be hereafter 8
designated by the state highways and transportation 9
commission with the approval of the Secretary of 10
Transportation, pursuant to Title 23, United States Code, as 11
amended; 12
(3) "Raw materials", materials intended for use to 13
produce construction materials, including, but not limited 14
to, sand, gravel, and rock. 15
2. Subject to the requirements specified in this 16
section, vehicles transporting construction materials from 17
the site of their production to the site of a construction 18

project at which the materials will be used, or transporting 19
raw materials from their point of origin to a site at which 20
construction materials are produced, may exceed the weight 21
limits specified in section 304.180 by up to ten percent, 22
provided that the vehicle is properly maintained and 23
equipped to operate at the excess weight safely, and does 24
not exceed the gross vehicle weight rating for the vehicle 25
as specified by the vehicle's manufacturer. 26
3. This section shall not apply with regard to the 27
interstate system. 28
4. No vehicle operated at an excess weight in 29
accordance with this section shall be operated on any bridge 30
or other structure with a posted weight limit lower than the 31
vehicle's gross vehicle weight. 32
5. No vehicle operated at an excess weight in 33
accordance with this section shall be operated on any bridge 34
or other structure with any posted weight limit at a speed 35
greater than thirty miles per hour. 36
