SB 947 - Under the act, after the effective date of the act, an alien, foreign business, or foreign government shall not acquire any real estate, including agricultural land, in the state for any purpose within 50 miles from any military installation or commercial establishment engaged in the development and manufacture of classified military or naval equipment.

Any foreign entity who acquired real estate under the act prior to the effective date of the act shall divest himself of the real estate.

The Attorney General shall enforce provisions of the act. Any individual may report violations of the act to the Attorney General. If the Attorney General believes that a violation occurred, the Attorney General shall commence a civil action.

The Attorney General shall file a notice of the pendency of the action with the recorder of deeds of each county where any portion of real estate at issue is located.

If the court finds that a violation occurred, the court shall enter an order so declaring and shall file a copy of the order with the recorder of deeds of each county where the real estate at issue is located. The court shall order the owner of the real estate to divest himself of the real estate. The owner shall comply with the order within one year. Any real estate not divested within the one year period shall be ordered sold by the court at a public sale.

The act has an emergency clause.

AN ACT
To amend chapter 442, RSMo, by adding thereto one new section relating to foreign ownership of
real estate near military installations, with an emergency clause.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Chapter 442, RSMo, is amended by adding thereto 1
one new section, to be known as section 442.593, to read as 2
follows:3
442.593. 1. After the effective date of this act, an 1
alien, foreign business, or foreign government shall not 2
acquire any real estate, including agricultural land, in the 3
state for any purpose within fifty miles from: 4
(1) Any reservation, post, arsenal, proving ground, 5
range, mine field, camp, base, airfield, fort, yard, 6
station, district, or area of the Armed Forces of the United 7
States; or 8
(2) Any commercial establishment engaged in the 9
development or manufacture of classified military or naval 10
arms, munitions, equipment, designs, ships, aircraft, or 11
vessels for the Armed Forces of the United States. 12
2. Any alien, foreign business, or foreign government 13
who acquired real estate under this section prior to the 14
effective date of this act shall divest itself of the real 15
estate. 16

3. The attorney general shall enforce provisions of 17
this section. Any individual may report violations of the 18
provisions of this section to the attorney general. If the 19
attorney general believes that a violation occurred, the 20
attorney general shall commence a civil action in a court of 21
competent jurisdiction. 22
4. The attorney general shall file a notice of the 23
pendency of the action with the recorder of deeds of each 24
county in which any portion of the real estate under this 25
section is located. 26
5. If the court finds that a violation of this section 27
has occurred, the court shall enter an order so declaring 28
and shall file a copy of the order with the recorder of 29
deeds of each county in which any portion of the real estate 30
under this section is located. The court shall order the 31
owner to divest himself of the real estate. The owner shall 32
comply with the order within one year. Any real estate not 33
divested within the one-year period under this subsection 34
shall be ordered sold by the court at a public sale in the 35
manner prescribed by law for the foreclosure of a mortgage 36
on real estate for default in payment. 37
Section B. Because of the dangers of foreign ownership 1
of real estate located close to military installations, 2
section A of this act is deemed necessary for the immediate 3
preservation of the public health, welfare, peace, and 4
safety, and is hereby declared to be an emergency act within 5
the meaning of the constitution, and section A of this act 6
shall be in full force and effect upon its passage and 7
approval. 8
