SB 949 - This act creates the offense of judicial malfeasance. A person commits the offense if the person, while performing the duties of a judge, releases an individual who is a prior or persistent offender during the pendency of a criminal trial and such individual commits a felony during such release. The offense of judicial malfeasance shall be a class E felony. Any person charged or convicted with the offense of judicial malfeasance shall be referred to the Commission on Retirement, Removal, and Discipline for disqualification, removal, and suspension.

AN ACT
To amend chapter 575, RSMo, by adding thereto one new section relating to the offense of judicial
malfeasance, with penalty provisions.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Chapter 575, RSMo, is amended by adding thereto 1
one new section, to be known as section 575.340, to read as 2
follows:3
575.340. 1. A person commits the offense of judicial 1
malfeasance if the person, while performing the duties of a 2
judge in this state, releases an individual who is a prior 3
offender or a persistent offender during the pendency of a 4
criminal trial and such individual commits a felony during 5
such release. 6
2. The offense of judicial malfeasance shall be a 7
class E felony. 8
3. Any person charged or convicted with the offense of 9
judicial malfeasance shall be referred to the commission on 10
retirement, removal, and discipline for disqualification 11
from acting as a judicial officer. Any person who pleads 12
guilty or no contest to or is found guilty of the offense of 13
judicial malfeasance shall be referred to the commission on 14
retirement, removal, and discipline for removal and 15
suspension by the Missouri supreme court. 16

4. The terms "prior offender" and "persistent 17
offender" shall have the same meaning as such terms in 18
section 558.016. 19
