AN ACT
To amend chapter 37, RSMo, by adding thereto three new sections relating to the Missouri GIS
advisory council.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Chapter 37, RSMo, is amended by adding thereto 1
three new sections, to be known as sections 37.1300, 37.1310, 2
and 37.1320, to read as follows:3
37.1300. For the purposes of sections 37.1300 to 1
37.1330, the following terms mean: 2
(1) "Council", the Missouri GIS advisory council 3
established in section 37.1310; 4
(2) "Geographic information system (GIS)", a computer 5
system for capturing, storing, checking, and displaying data 6
related to positions on the Earth's surface that enables 7
easily seeing, analyzing, and understanding patterns and 8
relationships; 9
(3) "Geospatial", relating to or denoting data that is 10
associated with a particular location; 11
(4) "Missouri Spatial Data Information Service" or 12
"MSDIS", Missouri's primary spatial data clearinghouse 13
responsible for collecting and distributing vector data, 14
aerial photography, and light detection and ranging 15

elevation data that are generated, updated, and funded by 16
state, local, and regional agencies and governments. 17
37.1310. There is hereby established within the office 1
of administration the "Missouri GIS Advisory Council", which 2
is charged with assisting and advising the state in ensuring 3
the availability, implementation, and enhancement of a 4
statewide geospatial data infrastructure common to all 5
jurisdictions. The council shall be established within the 6
information technology services division of the office of 7
administration. The council shall serve to support the 8
existing geospatial infrastructure within the state of 9
Missouri and strive toward immediate access to statewide 10
geospatial data for all citizens of this state, especially 11
life-safety entities including NG9-1-1. 12
37.1320. 1. The council shall consist of members that 1
represent a cross-section of subject matter experts striking 2
a geographic balance from all regions across the state. 3
Representation should at a minimum include: 4
(1) The commissioner of administration, or the 5
commissioner's designee; 6
(2) The director of the department of conservation, or 7
the director's designee; 8
(3) The director of the department of economic 9
development, or the director's designee; 10
(4) The director of the department of health and 11
senior services, or the director's designee; 12
(5) The director of the department of natural 13
resources, or the director's designee; 14
(6) The adjutant general of the department of the 15
national guard, or the adjutant general's designee; 16
(7) The director of the department of public safety, 17
or the director's designee; 18

(8) The director of the department of transportation, 19
or the director's designee; 20
(9) The director of the United States Geological 21
Survey, or the director's designee; 22
(10) The chief of the United States Department of 23
Agriculture – Natural Resource Conservation Service, or the 24
chief's designee; 25
(11) The chair of the Missouri 911 service board, or 26
the chair's designee; 27
(12) The director of the Missouri Spatial Data 28
Information Service, or the director's designee; 29
(13) The director of the state land surveyor program, 30
or the director's designee; 31
(14) The director of the National Geospatial Agency 32
West, or the director's designee; 33
(15) The secretary of state, or the secretary's 34
designee; and 35
(16) No less than fourteen citizens of Missouri, 36
appointed by the commissioner of administration or the 37
commissioner's designee. Such individuals shall represent 38
federal, city, county, and local government; the private 39
sector; public safety; licensed professional land surveyors; 40
and academia. 41
2. By invitation of the council, additional subject 42
matter experts may participate in activities as noncouncil 43
members and do not require an appointment by the 44
commissioner of administration. 45
3. Appointed members of the council shall serve two- 46
year terms and shall serve until their successors are 47
appointed. Vacancies on the council shall be filled in the 48
same manner as the original appointment and such member 49
appointed shall serve the remainder of the unexpired term. 50

4. The council shall convene, at a minimum, quarterly 51
and as otherwise required by the commissioner of 52
administration or the office of geospatial information. 53
5. The council shall designate from its members a 54
chair and chair-elect for one-year terms and shall adopt 55
written guidelines to govern the management of the council. 56
6. Each appointed member of the council shall serve 57
without compensation but may be reimbursed for the actual 58
and necessary expenses incurred in the performance of their 59
duties as members of the council, subject to appropriations 60
for the council. 61
7. The council shall designate from its members an 62
executive secretary for the council, who shall maintain the 63
records and decisions of the council's activities in 64
accordance with state statute and shall be responsible for 65
correspondence between the council and other agencies. 66
8. The council shall not collect any personally 67
identifiable information of any individual person. For 68
purposes of this subsection, the term "personally 69
identifiable information" means information that can be used 70
to distinguish or trace an individual's identity, such as 71
name, social security number, or biometric data records, 72
either alone or when combined with other personal or 73
identifying information that is linked or linkable to a 74
specific individual. 75
